Once a demurrer to evidence has been granted in a criminal case, the grant amounts to an acquittal. Any further prosecution for the same offense would violate the accused's constitutional right against double jeopardy.

What is a "Demurrer?" Strange term.

A demurrer in Virginia law is a responsive pleading to litigation that challenges the sufficiency of the Complainant's pleading. Instead of an answer, a defendant can file a pleading called a demurrer. It kinda says "so what?" ...even if everything you say in this complaint is true, you fail to state any kind of legal claim. Along with the demurrer, a defendant can also file a Motion to Dismiss.
