“I don’t usually write letters saying the First Amendment does NOT apply. This was a situation in which I—and all these other scholars and professors—thought that it was ‘frivolous’ to maintain that the First Amendment protected President Trump with respect to his impeachment, and with respect to the facts of this case,” says legendary First Amendment attorney Floyd Abrams.

"It wasn't 'til the beginning of the twentieth century that we started to have real First Amendment cases in the courts, and that wasn't 'til World War I began and socialists and anarchists were jailed for giving speeches opposing the war even after the war began. And the government took the position under the Espionage Act, which still governs us and was adopted a hundred years ago this year, the government took the position [that] if you're allowed to say things like that, it will deter people from enlisting in the army. It will lead to the U.S. having less of a chance to win the war, which was then underway. And so we had a number of cases, including one in which Eugene Debs, a Socialist candidate who got three million votes in the election, was jailed for a number of years for his advocacy against World War I. And those were the cases that started to have the great dissenting opinions of Justice Brandeis and Justice Holmes, which were really the beginning of the development of serious protective First Amendment law in this country, initially as dissenting opinions, later by popular acclaim understood to be appropriate statements of what the First Amendment means, leading to and then cited in opinions in mostly the second half of the twentieth century, I mean, within living memory - of me, and some other people in this room. The Pentagon Papers case was mentioned. That was a pretty big deal in terms of having it now in our arsenal. The case the decade before, New York Times against Sullivan that I mentioned in libel law - pretty big deal in terms of protecting the press and all public speakers in situations in which otherwise it might be very possible for a president, or just powerful people with a lot of money, to step in and suppress speech of great importance."
Floyd Abrams at the Carnegie Council for Ethics in International Affairs, June 1st, 2017

Don’t Speak: Is the Media Under Attack?
Don’t Speak: Is the Media Under Attack?
The press speaks truth to power. And in doing so, helps uphold the rule of law. But what happens when people can sue publications into bankruptcy – effectively silencing them. Should that be allowed? Should wealthy people or corporations be able to silence publications they don’t like? In the documentary, “Nobody Speak: Trials of the Free Press” the connection between money and the media is…
