The Basic Requirement
USCIS requires that the beneficiary of an H-1B petition demonstrate educational qualifications that meet the specialty occupation standard. For most positions, this means the equivalent of a U.S. bachelor's degree in a directly related field.
For applicants with U.S. degrees, this is straightforward. For applicants with foreign degrees, a credential evaluation is necessary to establish that the degree meets the standard.
The evaluation must be prepared by a qualified individual - typically someone with expertise in international credential assessment - and must explain the basis for its conclusion in a way that USCIS can evaluate.
What Happens When the Degree Is Three Years
Many applicants from India, the United Kingdom, and other countries hold three-year bachelor's degrees. This is the standard program length in those countries, but it does not automatically satisfy the U.S. four-year bachelor's degree requirement.
A three-year degree can qualify for H-1B purposes, but the evaluation needs to address the program length directly and explain how the degree meets U.S. equivalency standards. This may involve referencing the academic system of the country, comparing credit hours, or - in some cases - combining the degree with qualifying work experience.
An evaluation that does not address the three-year issue is likely to draw a Request for Evidence. Addressing it proactively in the evaluation is the more effective approach.
When Work Experience Can Help
USCIS allows three years of specialized, progressive work experience to substitute for one year of U.S. college-level education. For an applicant who lacks a four-year degree, this pathway can be used to establish the educational equivalent.
To use this pathway, the evaluation must cover both the academic credentials and the work history. The work experience must be documented through employer letters that describe specific duties and demonstrate that the responsibilities increased in complexity over time.
This type of evaluation - combining education and work experience - is more specialized than a standard document evaluation. Not all agencies offer it. Selecting one that does not is a common problem in cases involving applicants without traditional degree paths.
What to Prepare Before Filing

Official transcripts from every institution attended
Degree certificates or diplomas
Certified translations of any documents not in English
Employer letters if work experience will be part of the evaluation
