Black Mom, White Child? Judge says Only Love Matters

FLINT, Mich. – Stacey Bush’s new life started Thursday with a lollipop from a Genesee County judge, a huge from her teary-eyed new mom and a huddle of news media. 

“How do you feel?” the shy 9 year old was asked.

“I feel happy”.

What a silly question.

For the last year, Stacy has wanted Regina Bush her temporary foster mom , to be her permanent mom.  In a lawsuit, Bush , a single black woman and Stacey, who is white say authorities tried to block the adoption because of the racial difference.

  But after months of legal wrangling, psychological testing, family background checks, financial disclosures and evaluations by two experts, the state finally agreed that the bond of love between Stacey and Bush should not be broken.

  After six years of being shuttled among foster homes, Stacey now has a forever-family.

  “Thank God,” Bush said.

  “Race is not an issue I my family.  We’re already a culturally diversified family.”

  The battle over interracial adoption was settled more than a decade ago, when federal courts rules that agencies could not block them because of race.  All of those cases involved white parents trying to adopt black children.

  Stacey and her half-sister Sara 6, came under the supervision of the Oakland County Family Independence Agency in 1992 after their biological mother and her boyfriends abused and neglected them.  The Oakland County FIA hired Oakland Family Services in Pontiac to provide the girls with care.

  Sara, whose father is black, came to Bush’s home in Mt. Morris near Flint in 1995.  Bush later adopted Sara, who joined four other black children – Justin, 7, Jeron, 5, and Bush’s biological teen-age daughters Tiffany and Latasha.

  Stay whose biological parents are white came to the Bush home last April after her placement with a white foster family I Clarkston had been disrupted.  It had been her third placement, and Stacy said she had been abused in a previous foster home.

  Bush, a state child-care specialist at the Maxey Training School near Whitmore Lake figured adopting Stacey would be easy because of the FIA’s policy of adopting siblings into the same family.  But it wasn’t that easy.

  When Oakland Family Services worker told Bush they were concerned about “cultural issues” and were considering moving Stacey to another foster home, Bush got scared and angry.

  She said she was certain she and Stacy were being discriminated against.  She hired attorneys’ Justin Ravitz and Patricia Stamler who filed a civil-rights lawsuit against Oakland Family Services in U.S. District Court in Detroit.

  Oakland Family Services and the Oakland County FIA continued to oppose the adoption but were under court order not to remove Stacey form Bush’s care pending further hearings. Genesee County FIA, which was also involved in the case disagreed with its Oakland County colleagues and recommended the adoption be approved.

  Bill Johnson, director of the FIA’s Michigan Children’s Institute, had final say. His office oversees the adoptions of children who are permanent court wards because of abuse or neglect.

  “I think people were making recommendations on what they felt was best for Stacey,” sand Johnson who approved the adoption in February.
