In 2011, 68-year-old Kenneth Chamberlain, Sr. accidentally activated his Life Alert pendant. The former Marine and retired corrections officer had a cardiac condition. Life Alert dispatch sent police, Fire, and EMS to his home.
When police arrived, Chamberlain said he hadn’t meant to activate his pendant and he did not need help. Police continued to insist that he let them in and tried for an hour to get him to open the door, with one officer cursing and calling him a racist slur. They finally broke down the door. He was tased before he was shot, and officers claimed that he was charging them. The autopsy later showed that he had his hands at his sides when he was shot.
For reference, we respond to medical alarm pendant activations all the time. Never have we EVER forced our way into a home, with or without police, with the resident telling us they didn’t mean to activate it and they didn’t need help. Eight out of ten activations are accidental; it happens so often that running on one that’s legit is surprising.
I still can’t believe that all of the law enforcement agencies that investigated declined to press charges. Even the DoJ refused. That defies my understanding. I have just learned, however, that in June of this year an appeals court reinstated most of the charges against the officers in a civil suit, including unlawful entry and excessive force.
There won’t be justice as long as officer Anthony Carelli walks free and continues to work as an officer, but restoring the civil suit is a start.
