Legal Webinar in Malaysia (20210813)
Yesterday, I attended a webinar - a sharing session from two Practicing Malaysian lawyers. It gives many great suggestions regarding legal practice, lawyer ethnicity, and legal study.
According to CLP studies, it needs a lot of memorizing, thus self-discipline and stick to a schedule are very important. He also describes that the CLP exam is marked by the Practicing lawyers, therefore the answer must be straight to practical issue and solution.
From the aspect of studying law, the self-study mode is more advisable rather than grouping. The reason is the others may not be the same study pace as you did. I did agree but I still like to group study when it is mutual motivation. Participating in an internship is very useful for legal research and legal drafting, but you must have the initiative to ask for substantial work. Besides that, writing is a crucial skill in the legal field where repetition can help to improve its quality and quantity ( save time). Writing cannot simply follow others' format or style, so you must apply your mind in writing. It is the same as developing the oral style during the dispute. ( the legal skills will be continuing to advance throughout your life)
During the study in CLP, the ethic of a lawyer cannot have a side business simultaneously, but if having such demands can apply to the Malaysian Bar Council for approval. ( generally not approvable)
In an aspect of legal experience, they told the procedure of document amendment and evidence collection, cross-national cases, foreigner cases, cryptocurrency cases, white-collar field, etc.
I will briefly told about the issues that occurred in the cases above. A case involved a foreigner may have difficulties in the court especially the communication even assist with a translator. The cryptocurrency case is quite a new case where no precedent in Malaysia. The defendant argued that it is not defined as property in law, thus lawyers are allowed to use the persuasive precedent ( UK cases to argue). Next, the cross-national cases are always an issue in deciding which court to settle the dispute ( Eg: whether in Malaysia or Australia)
furthermore, there is no difference between solicitor and barrister in Malaysia. it is due to Malaysian lawyers can do both positions interchangeably that unlike in the UK. ( Eg: in the UK, the barrister cannot do solicitor work as well a solicitor cannot hold a barrister position)
In conclusion, it is an attractive and challenging career even it may be struggling. Believe in yourself and cross the obstacles.
