Business Trots

The urge to win the business game gives rise to the use of unfair means of throwing the competition out of business; hence business trots came into existence. Unfair means like unfair competition, fraud, misrepresentation and the breach of fiduciary duty are common business trots practiced by the person or a company against the other. 

The most common type of business trot is misrepresentation. Through misrepresentation, the intention is to stop the other party to act by giving away fake or false information preventing the person or the company to perform any act, resulting in a loss. This type of business trot case is difficult to prove in the court of law, unless somehow, the party proves that it way in a way reliant on the other party and was mislead to make a wrong decision. The betrayal of trust needs to be proved to make an effective business trot case.

Intellectual property infringement - When a company violates trade mark rights, violates copyright or patients. Usually competitor’s do so to the other out of business to damage the goodwill of the owner of the intellectual property.

Breach of Fiduciary Duty – When the company or the individual misguides others thus preventing them from their earning or forcing them to refrain to act in their best interest. 

Tortuous Interference – This business trot is divided into two parts (a) Interference with the contractual rights (b) interference with business relationship. In both, the intentional act of holding back another party from entering to a business relationship or entering into a contract thus damaging the future earning or wilfully causing harm to the business entity becomes the cause of business trot.   

By far all misdeeds conducted by the person or a business entity that cause harm either to impair the earning or to cause harm to the goodwill of the other come under business trots.
