Willy Mutunga Vows To Fly With Miguna Back To Kenya

Willy Mutunga, Former Chief Justice of Kenya has promised to travel to Canada and accompany deported lawyer Miguna Miguna as he will be coming back to Kenya on 16th next month.

“I have decided to travel to Toronto, Canada, to accompany Mr. Miguna on his flight back to his motherland on 16 November 2021,” said the former Chief Justice.

Dr. Mutunga served as the CJ between 2011 and 2016. He said his decisions follows personal reflections and consultations with lawyers, human rights and justice defenders, progressive politicians and Mr. Miguna himself.

“First is because of the continued, flagrant and reprehensible defiance of the Government of Kenya, its agencies and senior officials, against the numerous valid court orders in favour of Mr Miguna,” said Mutunga on a statement.

“The second reason … is to support and defend the independence of our Judiciary, its authority and the people’s confidence in it,” he further stated.

“I am ready to accompany CJ Emeritus Dr Willy Mutunga to Canada to bring Miguna Miguna back home on November 16, 2021. The rule of law, respect for Court orders and the defense of the Constitution is the responsibility of all Kenyans in general and all leaders in particular,” said Havi on Wednesday.

Miguna was deported to Canada after he took part in the swearing of former Prime Minister Raila Odinga as the people’s president in 2018 March. He attempted to come back but was detained for 3 days at JKIA before being deported back via UAE to Canada.

In December 2018 Justice Chacha Mwita awarded Miguna Ksh.7 million in damages and Ksh. 270,000 for the damage of his house.

Mutunga is calling for, among others, withdrawal of the red alerts issued against Miguna Miguna by the government and issuance of a Kenyan passport to Miguna.

“Court orders are not suggestions. They are not requests. They cannot be disregarded without consequence,” stated Mutunga

Self-declared war time Law Society of Kenya`s President Nelson Havi has distance himself from allegations of playing a one man`s show in his presidency at the Law Society of Kenya.

Speaking in one of the national media houses in Kenya, Nelson Havi has asked the Judicial Service Commission (JSC), not to swear in any Chief Justice unless the President of Kenya Uhuru Kenyatta paves way for the swearing in of the 40 judges proposed under the leadership of the former Chief Justice the Retired David Maraga a year and a half ago.

This comes even as the LSK has expelled eight council members following chaos experienced on LSK Mondays meeting, with the issue to do with money and power being suspected to be fueling the wrangles, an act that has been said t diminish LSK`s stature.

Havi has insisted that he is in as president to redeem the image of LSK and clear corruption and make it easier for his predecessor to run the LSK body while also challenging the top political leaders in Kenya to uphold the law and not to allow anything or anyone to derail it.

Concerning the two third gender rule that has not been reached upon according to the law of Kenya that was directed to the president of Kenya Uhuru Kenyatta, Havi has insisted that no one is above the law.

Nelson Havi`s is the first judge to take the judge to the court over corruption and won the case, his term is yet to expire on the 24th March, 2021. end
