tl;dr: You can opt out of Instagram’s arbitration term for a limited time.
I recommend reading the new T&C’s for Instagram rather than just ignoring the notice header. One highlight is binding individual arbitration (with a few exceptions) with arbitration opt out instructions. While these types of terms are not unusual, I’m not a fan of individual binding arbitration clauses for consumer goods and services. Most harm in these types of situations only result in enough damages to justify a lawsuit when pooled together in a class action. As a result, many unacceptable activities by the company can easily (cheaply) go unchecked.
It’s also worth noting arbitration is generally subject to non-disclosure agreements meaning each individual that goes through arbitration, so even for identical issues, consumers have no way of knowing about other claims or outcomes.
