Generally, the definition of "official"/commercial work is relaxed to what would make the most sense. In this case, to my knowledge Owata has never appeared in such a work, only in free games, so using free games, with some caveats, is broadly acceptable.

I Wanna Be the Guy Remastered is a little weird in this regard: it's technically a fanmade remake in a different engine and as such isn't really official per se, but it is endorsed by Kayin, the original dev, who was inspired by Owata, so I guess it could be fair game?

But also, hey, an ASCII Guile's in Owata's own game, which is simpler and feels more "official" in the context of Owata, whatever that means, so...?

2 feels more right to me, but it is all just varying degrees of shaky justification.
