PoSH (Protection of Women from Sexual Harassment) Act, 2013
Our society still views sexual harassment as taboo, and as a result, such concerns are likely to make the workplace unfriendly and unfit for employment.
The Indian Constitution's Article 14 guarantees that all citizens would be treated equally in front of the law, as stated in the Preamble to the Constitution. As a result, women are legally entitled to a safe workplace. Articles 14, 15, and 21 of the Indian Constitution actually deal with equality and freedom.
This is against a woman's dignity, bodily and mental health, as well as her fundamental rights as stated in Article 19(1)(g) of the Indian Constitution. As a result, productivity is low, which has a negative effect on people's lives and livelihoods. Deep-seated socio-cultural tendencies that put victims in a gender hierarchy and reinforce gender inequality at work and in society as a whole further exacerbate the problem.
The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 is the law in India that addresses this (POSH Act). Because of the Act, women are shielded from sexual harassment at work. It also addresses the prevention and resolution of sexual harassment claims.
In order to protect women from sexual harassment at work and to create a secure working environment for them, the PoSH Act has been put into effect.
MANDATORY STEPS TOWARDS POSH COMPLIANCE
The POST Act mandates that an organization must implement the following steps to remain compliant:
Step 1: Draft an organizational policy on the Prevention of Sexual Harassment (POSH policy).
Step 2: Change the employment contract to reflect the organization's POSH policy.
Step 3: Constitute an Internal Committee (IC) to handle complaints related to sexual harassment.
Step 4: Create awareness among the employees about their rights and responsibilities toward creating a safe workplace.
Step 5: Submit Annual Report on POSH Compliance.
