Erie concern is charged with smuggling in quantity rubber heels ---- PEDDLING CASE ---- FORT ERIE, Oct. 24 - (Special)- Two contentious cases were adjourned in Fort Erie police court yesterday by Police Magistrate William T. Malkin.
The charge against a Fort Erie concern of smuggling in a quantity - of rubber heels, polish in bottles, laces, etc. from the United States in contravention of Section 217 of the Customs' Act, was adjourned for one week. Collector of Customs Frank T. Pattison, and Charles H. Price and William G. Stamp of the staff were present to give evidence but after a short discussion the adjournment was granted to allow the Crown to produce additional proof.
Wendel M. Musgrove of Niagara Falls appeared on behalf of Gordon Lapp, Sherkston man charged with violation of the Hadker's and Peddlers' Act. After some discussion this case was adjourned until Wednesday of next week, in order to produce witnesses. This was satisfactory to Mr. Musgrove.
No plea was taken in view of the amicable agreement to postpone, although there was some discussion by counsel as to the points involved in the interpretation of the local by-law and the provincial act in this regard.
