Page 3. ---- Alleged Assailant Denied Freedom Pending Victim's Recovery ---- Alfred Leclaire, 1485 Mount Royal avenue east, will not be allowed bail until the life of Yee Chong Wong, elderly proprietor of the Canton Inn, 81 Lagauchetiere street west, is declared out of danger by hospital authorities, Judge Desmarais ruled to-day when Leclaire appeared before him for preliminary inquiry into an assault charge laid as the result of a brawl which occurred at Yee's restaurant on the morning of March 10.
When Leclaire's case was called, Albert Berthiaume, K.C., police attorney, asked for a postponement, explaining that Yee was still in a critical condition and had not yet given his version of the brawl that resulted in his receiving a fractured skull and a broken arm. The court agreed to postponement, fixing the inquiry for March 27.
On being notified of the postponement, Leclaire immediately requested the court to fix his bail.
REQUEST DENIED Mr. Berthiaume objected to the granting of bail at the present time. 'The victim, he said, was still in a critical condition and he did not think it would be wise to allow Leclaire his liberty until there was definite assurance that the Chinese would recover. Judge Desmarais agreed and refused the application.
"I would also ask the court that Leclaire be remanded to headquarters until the hearing," Mr. Berthiaume said, explaining that it might be necessary to rush the accused to any moment for at the hospital identification purposes. If Leclaire were at the Montreal jail valuable -time might be lost. The remand to headquarters was also granted.
Mystery surrounds the actual facts of the case that resulted in the in-juries to Yee. Investigation by police indicates that Leclaire was one of a party of four who visited Yee's premises on the morning of March 10. A brawl occurred while they were there and Yee was thrown or fell down stairs. Yee's condition has not yet permitted him to give his version of the affair.
