How Traffic Court Works

When a traffic ticket is issued, usually a small fine can be paid and that is the end of the matter. However, sometimes the traffic violation requires an appearance in court. If this happens to you, it is natural not to know what to expect. Most people have never been in this situation. Learn the ins and outs of traffic court hearings.

Before Court

First things first, there is a chance you do not necessarily need to go to court. In some states, you can admit your guilt and pay the fine online or by mail. Sometimes, however, this is not an option. Additionally, you can contest any ticket rather than pay the fine. If you do end up going to court, the first thing that will happen is called arraignment.

Arraignment

Arraignment is the first day of court where administrative aspects are handled. Your arraignment will be handled at the same time as many others', usually at least a dozen or two. The judge will begin calling cases, usually going in alphabetical order. When your case is called, you will need to step up to the podium and either plead guilty or not guilty. It is very common for judges to reduce the fine for people who plead guilty.

You can pay attention to all the cases that get called prior to yours. If the judge is reducing fines often, you can expect yours to be reduced as well. This should factor into your decision of how to plead. If you plead not guilty, a date will be set for your trial.

Trial

At the trial, you and the police officer who issued the ticket must appear together. If the police officer does not show up, the charges will almost certainly be dropped. It is actually relatively common for police officers to not come to traffic court.

If the police officer does appear, however, then the trial will begin. The police officer will present the evidence that you are guilty, and then you will have the opportunity to present your own argument. It can be challenging for an average person to present a compelling argument, as it requires extensive legal knowledge. It may be a good idea to hire an attorney to represent you, even in traffic court cases.
