Today I studied yet more Contracts, both under the common law and the UCC (Uniform Commercial Code). We looked at various ways a Contract might be void or voidable (illegality, unconscionability, duress), the Statute of Frauds, warranties, and even conditions of performance.

Today I watched Cane Crazy and Flood Sweat and Tears. More funny espacades. Even if Season 1 is laregly episodic, you can really tell this is still very early on. There's a fear Hop Pop will kick Anne out, Polly is still 50/50. Our first townie in Loggle the Axolotl.

Connection: Sprig trades one click pen for the entirety of the costs of damages to Loggle's woodsmithing (carpentry?) shop from a giant stickbug attack. This probably does have consideration and is not covered by the Statute of Frauds. It may however, face problems of substantive unconscionability. A judge might look at the exchange of one pen for damages and, if Loggle brought suit, find the terms shockingly unfair and unmake the contract. On the other hand, a click pen is very rare in Amphibia, and frogs seem to value it's clickyness (understandable) so it might slide by. Also I don't know what legal system Amphibia uses, but thats a whole thing.

Because I'm tired of constantly repeating myself, here's some information for my potential Clients:

I'm not interested in NFTs.

If you want to order a drawing, painting or print, send me a private message. I won't write first, as requests to write first are usually spam or attempted fraud.

I don't use PayPal due to constant fraud attempts.

I usually don't respond to messages from newly started blogs, as they are usually bots or scammers.

I'm based in Poland and ship to any country.

When placing personalized orders, please provide the following information: the format of the ordered drawing, the style, as I experiment with different ones, the technique, realism or surrealism, color or monochrome, and the deadline.

I don't currently draw digitally.

I take a deposit of half of the final price of the drawing as security precautions, the other half after the Client approves the results.

My ability to make corrections in the final stages of working on a commission are limited depending on the chosen technique of the drawing/painting.

Size matters. I don't draw under a microscope and I'm not a miracle worker, so if you're ordering a small-format portrait, don't expect me to be able to perfectly capture the likeness of very small figures.

After accepting the final drawing, I don't accept returns and am entitled to full payment.

If I start working on the drawing and you cancel, the advance payment is forfeited.

If I finish working on the drawing and you cancel, I am entitled to the full fee for completing the order.

Due to health issues, the delivery date may be extended for reasons beyond my control, so order in advance if time is a priority for You.

I don't tolerate pressure; art sometimes takes time. I prefer to deliver a drawing I'm happy with than something drawn under stress.

I require good manners and respect for my time from my Clients.

Zazwyczaj nie odpisuję na wiadomości z nowo założonych blogów, ponieważ są przeważnie botami lub scammerami.

Stacjonuję w Polsce, wysyłam do każdego kraju.

Przy składaniu zamówień spersonifikowanych podaj następujące informacje: format zamówionego rysunku, styl, ponieważ eksperymentuję z różnymi, technikę wykonania, realizm czy surrealizm, kolor czy monochrom, deadline.

Nie rysuję obecnie w digitalu.

Biorę zaliczkę w wysokości połowy ceny końcowej rysunku jako zabezpieczenie, drugą połowę po zaakceptowaniu rysunku przez Klienta.

Możliwość naniesienia poprawek w etapach końcowych jest ograniczona w zależności od techniki.

Format ma znaczenie - nie rysuję pod mikroskopem i nie jestem cudotwórcą, więc jeśli zamawiasz portret na małym formacie nie wymagaj, że będę w stanie idealnie oddać podobieństwo bardzo małych postaci.

Po zaakceptowaniu końcowego rysunku nie przyjmuję zwrotów i przysługuje mi pełne wynagrodzenie.

Jeśli zacznę pracę nad rysunkiem, a Ty zrezygnujesz, zaliczka przepada.

Jeśli skończę pracę nad rysunkiem, a ty zrezygnujesz, przysługuje mi pełne wynagrodzenie za wykonanie zamówienia.

Ze względu na problemy zdrowotne termin dostarczenia zamówienia może się przedłużyć z przyczyn niezależnych ode mnie, dlatego zamawiaj z wyprzedzeniem, jeśli zależy Ci na czasie.

Nie toleruję presji, sztuka wymaga czasem czasu. Wolę oddać rysunek, z którego będę zadowolony, niż coś rysowanego pod wpływem stresu.

Od klienta wymagam odpowiedniej kultury osobistej i szacunku do mojego czasu.
