Eviction
Can I appeal an eviction when a writ of restitution has already been granted and how do I stay in my home?
You can stay the writ by paying the judgment and moving the Court to reconsider or revise its decision. You have to also ask (move) the court to stay the writ. This is a lot of effort for what is probably a losing battle. Eviction If you didn't pay your rent, or were late responding to a 3-day pay or vacate notice, and your landlord jumped through all the procedural hoops correctly, then you have been (unfortunately) properly evicted. The downside to arguing a futile case is that in the area of landlord-tenant the law provides for fee-shifting. That means you can run up your landlord's attorney fees and pay all those fees. Also, WA is traditionally very landlord-friendly, because the persons with money to lobby the legislature for favorable laws are the landlords, not the tenants. The primary basis for the common law, really, is property rights. The owner of the property has the right to do as he/she sees fit in regards to his/her property. And if you don't pay the rent, then you have no rights in the property. I realize this is not what you wanted to hear, but I would be doing you a disfavor if I tried to encourage you to do otherwise. Without knowing anything more about what happened, likely you'll be better off turning your energy towards finding a new place to live. In Pierce County, the writ is posted the day after it is issued. Then, the writ has to sit for three judicial days. Then the landlord has to contact the Sheriff to schedule the physical eviction. There is a backlog. Chances are it will not happen the same day. The sheriff will post ANOTHER notice telling you exactly when the physical eviction is scheduled in the hopes that you will be gone before then. But if you are still there they will show up and make you leave.
Here's a story about the frustration of my last two days..
Some friends and I had signed a contract and paid the deposit for a house in January, yesterday I had a phone call saying that the current landlord has sold the house, and the new one didn't want tennants. So we were offered a new house, 1/3 of the size of the old one with summer rent free.
We took a look today, and on the way back from the viewing, I got a phone call saying that the house has just become unavailible. And am offered the option of two other places too far away from town, or to have the new landlord's estate agents to phone me and work something out.
I get a call again later saying that the house now DOES want tennants, so I am getting the deposit money wired back to my account, and the previous signed contract going to the estate agents. On monday we have to go to the agency to chat about something or other (probably the contract) but will most likely not have the money by then. So if we get our first choise home back, we will have to pay the full rent that we were supposed to in the first place, but also have to pay for it over the summer. I'm not even sure if I have the money to do so until my bank account is sorted, either. I'm so frustrated and annoyed. I want this all to be over.
