Okay, from what I understand it's not illegal for a professional writer to view fanworks, but doing so opens them up to lawsuits and even losing their trademarks if they don't countersue. It basically creates a huge liability issue where the fanwork creator can claim a IP holder stole their ideas and if the IP holder doesn't have proof they sent a cease and desist to the fanwork creator, then it will be taken as proof they haven't been defending their copyright which is just a whole other can of worms.
Basically Trademark and Copyright law is just one whole big mess which fanworks have a complicated relationship with. Which is why everyone is advised to avoid the issue it if at all possible.
Aah, I see. So even though it isn't illegal, looking into fanworks does make them vulnerable to lawsuits, if I'm understanding this correctly. Yeesh. They really do be sticking their hands on the stove and think they can swipe it out fast enough not to get burned.
