Emmanuel and Brigitte Macron Expanded Their Candace Owens "Transvestigation" Lawsuit

Owens has pushed the lie that the First Lady of France is secretly trans.

Emmanuel and Brigitte Macron, the president and first lady of France, have expanded upon their lawsuit against right-wing pundit Candace Owens, for continually pushing the conspiracy theory that Brigitte is secretly transgender. The Macrons initially filed a 22-count U.S. defamation lawsuit against Owens in July. They alleged that she has shared “outlandish, defamatory, and far-fetched fictions” about Brigitte since March 2024, culminating in Owens’ eight-part series “Becoming Brigitte” on her podcast Candace earlier this year. Owens filed a motion to dismiss the lawsuit on September 12, with her lawyers claiming that the Macrons were committing “quintessential libel tourism” for pursuing legal action against her in the United States rather than in France, which has a three-month statute of limitations for defamation claims.

In response, the Macrons filed a 250-page amended complaint alleging that, since the couple filed their initial lawsuit, Owens has “unequivocally doubled down” on her claims. The complaint specifically calls out the newest season of “Becoming Brigitte,” released this month, in which Owens claimed that the first lady — who she insists was “born a man” named Jean-Michel — participated in the Stanford Prison Experiment “which Owens claims is somehow linked to her later ‘transition.’” Performed in 1971, the controversial psychological experiment recreated the conditions of a prison environment, assigning 24 Stanford University students to groups of guards and prisoners. Originally meant to last up to two weeks, the experiment was terminated six days in after the “guards” began abusing their “prisoner” peers.

[...] The Macrons aren’t the only political figures begging Owens to let her “transvestigation” of France’s First Lady go. During an August appearance on The Tucker Carlson Show podcast, she claimed that President Donald Trump personally called her back in February to ask her to stop claiming that Brigitte is trans. Owens told Carlson that although she replied that “it’s not my fault that he married someone with a penis,” she initially agreed to temporarily decrease her reporting on Brigitte.

Earlier this year, 16-year-old AB Hernandez became the target of nationwide hate and harassment when the president of a local school board publicly doxxed the track and field athlete and outed her as transgender. Right-wing activists misgendered her and called her mom “evil;” swarms of adults showed up to heckle her at games; Charlie Kirk pushed state governor Gavin Newsom to condemn her; and President Donald Trump threatened to withhold federal funding from California over her participation.

While transgender athletes are very rare, this type of harassment towards them is playing out across the country and internationally. A trans girl was harassed at a soccer game in Bow, New Hampshire, by adult protestors wearing XX/XY armbands, representing an anti-trans sports clothing brand. And in British Columbia, a 9-year-old cis girl was accosted by a grown man who accused her of being trans and demanded that she prove her sex to him. While research into the relative athletic capabilities of trans and cis women is ongoing, far-right groups, including the Alliance Defending Freedom and the Leadership Institute, have been putting hate before science to turn the public against trans athletes since at least 2014. And it’s working.

Laws, rules or regulations currently ban trans athletes from competing in sports consistent with their gender identity in 29 states, with 21 beginning the ban in kindergarten. The majority-conservative Supreme Court announced this month that it’ll be taking on the question of the constitutionality of the bans. Meanwhile, the federal government is pressuring states without bans to change their policies in compliance with a Trump executive order that attempts to institute a nationwide ban. These bans have been successful in part because of a toxic and ruthless ecosystem of far-right influencers, like Riley Gaines, who have formed entire careers around attacking trans athletes by prioritizing hate and misinformation. “So much of what we see … just seems like it’s wrapped up in really hateful and negative messages that aren’t good for anyone,” says Mary Fry, a professor of sport and exercise psychology at the University of Kansas. “We’re creating issues where maybe we don’t need to.” [...]

Caught in the Crossfire

The anti-trans attacks in sports are also affecting cis women. Ayala, a competitive cyclist, remembers one race where she and her trans friend both made the podium. When photos of the event were posted on Facebook, people accused her of being trans, and she was added to a “list of males who have competed in female sports” maintained by Save Women’s Sports. Ayala isn’t alone. Numerous cis female athletes have been “transvestigated,” or accused of being trans, including Serena Williams and Brittney Griner. During the 2024 Paris Olympics, Donald Trump and Elon Musk publicly accused Algerian boxer Imane Khelif of being trans after her gold medal win, as part of a wave of online hate against her. She would later file a cyberbullying complaint against Musk’s X. While women of all races have been targeted, Black women have faced harsher scrutiny due to stereotypes that portray them as more masculine.

Anti-trans policies banning trans women from women’s sports makes things worse for women’s sports as a whole.

Lady Gaga recently opened up about rumors that proliferated early in her career that she had a penis — and explained why she never denied them. Earlier this week, Netflix dropped its new show What’s Next? The Future with Bill Gates. The five-episode series features conversations between the billionaire Microsoft founder and various thought leaders and celebrities about the most pressing challenges of our age. In its second episode, Gates tackles truth in the age of digital misinformation, and one of the experts he turns to is Lady Gaga, who knows a thing or two about how false claims and rumors can spread online.

“So, when I was in my early twenties, there was a rumor that I was a man,” the “Born This Way” singer explains to Gates. “And I went all over the world. I mean, I traveled for tours, for promoting my records, and almost every interview I sat in they said, you know — well, there was this imagery on the, on the internet that had been doctored. And they were like, you know, like, ‘There’s this rumor that you’re a man.’ Like, ‘What do you have to say about that?’” As them notes, rumors that Gaga had — as one dubious gossip site put it at the time — “both male and female genitalia” seem to have peaked in 2009, a year after the release of her debut album The Fame. A photo taken that June during her set at the Glastonbury Festival appeared to show a bulge in her underwear, and the famously vicious gossip blogs of the decade used it to fuel wild speculation about the singer.

Discrimination against trans Olympians has roots in Nazi Germany

Despite being a time when people from all over the world come together in equality and peace, the Olympics are still uncertain territory for transgender athletes. There are no transgender athletes who are competing outside of the gender they were assigned at birth at this year’s Games. Transgender women who transitioned after puberty aren’t allowed to compete in major sports on a college level. Athletes Nikki Hiltz, a runner, and Hergie Bacyadan, a boxer, both identify as transgender (Hiltz also identifies as nonbinary), but both have always and continue to compete in the women’s division, which is the sex they were assigned at birth. Athletes who do not identify as trans, like Algerian boxer Imane Khelif, have also been scrutinized for their gender. Along with China’s Lin Yu-ting, Khelif is one of two women boxers who failed a “sex test” from the International Boxing Association last year. They have since been connected to discussions of sports and Differences of Sexual Development (DSD), a rare group of genetic and hormonal disorders allowed under International Olympic Committee guidelines. After Khelif’s Italian competitor Angela Carini conceded their match less than a minute into their bout, many have weighed in, including Elon Musk and J.K. Rowling.

Outside of the Games, trans people face so much backlash, often for simply existing. The conversation around sports is particularly fraught, from children’s athletics right up through the pros. Despite the International Olympic Committee vowing to be more inclusive, the future for trans athletes is unclear. It all raises the question: How did we get to this point, and did it always have to be this way? The answers found in historian and journalist Michael Waters’s The Other Olympians: Fascism, Queerness, and the Making of Modern Sports might be surprising. Waters’s book traces the emergence of Zdeněk Koubek, a track and field star representing the country formerly known as Czechoslovakia who, at 21, won two medals — a gold in the 800m and a bronze in the long jump — at the 1934 Women’s World Games. (The Women’s World Games was the precursor to women competing at the Olympics). In 1935, Koubek announced that he would be living life as a man and swiftly became an international celebrity.

Perhaps the most intriguing facet to Koubek’s story was in the public response. Koubek was more welcomed and celebrated than we might imagine. There was an open-mindedness and empathy to the reception of Koubek and his gender identity and expression in the 1930s. Waters also pinpoints where and when that changed, specifically at the 1936 Olympics in Nazi Germany. Armed with a propensity for eugenics, gender anxiety, and a startling lack of scientific evidence, a small set of Nazi officials influenced the International Olympic Committee into gender surveillance and trans panic — stuff that eerily mirrors the transphobic attacks that athletes, cis and trans alike, face today.

French President Emmanuel Macron and his wife, Brigitte, will present scientific evidence in court that Brigitte is a cisgender woman, their lawyer says. The evidence will come in a defamation suit the Macrons filed against far-right influencer Candace Owens, a transphobe who has baselessly claimed that Brigitte Macron was born with male sex characteristics and is therefore transgender. They filed suit in July in Superior Court in Delaware over allegations that Owens has made since March 2024. Owens has “endorsed, repeated, and published a series of verifiably false and devastating lies about the Macrons, on which this complaint is based,” the suit says. “These outlandish, defamatory, and far-fetched fictions included that Mrs. Macron was born a man, stole another person’s identity, and transitioned to become Brigitte; Mrs. Macron and President Macron are blood relatives committing incest; President Macron was chosen to be the President of France as part of the CIA-operated MKUltra program or a similar mind-control program; and Mrs. Macron and President Macron are committing forgery, fraud, and abuses of power to conceal these secrets. These claims are demonstrably false, and Owens knew they were false when she published them.” In court, there will be “expert testimony that will come out that will be scientific in nature,” Tom Clare, the Macrons’ lawyer in the case, recently said on the BBC’s Fame Under Fire podcast. He declined to reveal specifics but said Brigitte Macron is committed to openness in the matter, even though it will be uncomfortable for her.
