Assam Introduces UCC Bill, Tribal Communities Kept Outside Its Scope

The Bharatiya Janata Party government in Assam has introduced the Uniform Civil Code (UCC) Bill in the state assembly during a special session led by Chief Minister Himanta Biswa Sarma. With this move, Assam becomes the third BJP-ruled state after Uttarakhand and Gujarat to move forward with a UCC framework.

The government says the bill aims to ensure gender equality, regulate marriage and inheritance laws, and eliminate social practices such as polygamy. However, tribal communities have been excluded from the law’s scope, a move widely seen as an attempt to maintain political and social balance in the state’s diverse demographic landscape.

Key provisions of the proposed law include a ban on polygamy, a uniform minimum age for marriage across communities, mandatory registration of marriages and divorces, equal property rights for women, and legal regulations for live-in relationships.

Opposition parties strongly protested the bill in the assembly, accusing the government of pushing through major social and legal reforms without broader public consultation. The debate over the bill is now expected to intensify as the country watches how the legislation evolves before its final passage.

UCC : Historic, Uttarakhand becomes first state to pass bill by voice vote ; This law is not against anyone Says Pushkar Singh Dhami

The Uniform Civil Code Uttarakhand 2024 Bill, introduced by Chief Minister Pushkar Singh Dhami-led state government, passed in the House. After passing the UCC Bill in the Assembly, Uttarakhand has become the first state in the country to implement the Uniform Civil Code.

The Bill, which was passed by voice vote, was introduced in the BJP-majority assembly a day earlier and the opposition had suggested that it should be sent to a select committee of the House first.

Uttarakhand Minister Prem Chand Aggarwal told ANI , “When the law is implemented, all ill societal norms would be eradicated and women would be empowered… Everyone supported it because this was a topic which could not be opposed… The bill will first go to the Governor, then to the President and then we will implement it in the state as a law…”

Once the Bill gets the governor’s consent, Uttarakhand will become the first state after independence to get a common law on marriage, divorce, land, property and inheritance for all citizens, irrespective of their religion.
