User Agreement

Cherp.Chat and all staff affiliates are not responsible for the content of all users. All rules put in place have been in good faith in both the functionality and protection of the userbase and Cherp.Chat staff is not responsible if the rules of the agreement have been breached after the binding user agreement. By abiding by the agreement, the user of the site agrees that they have read the rules and regulations, as well understands them. If there are concerns, they have already approached the staff with their concerns PRECEDING any disciplinary measures. As of 9/16/2020 logging in to an existing account, or creating an account will be a binding agreement from the user that they have done and understands the following:

Read, understood, and contacted staff with any concerns regarding the tagging guidelines that are presented on both the Cherp.Chat site and the Cherp.Chat official Tumblr page.
Read, understood, and contacted staff with any concerns regarding the Code of Conduct (CoC) agreement that is presented on both the Cherp.Chat site and the Cherp.Chat official Tumblr Page.
Understand that by breaching any of the rules or guidelines outlined in the provided media, they forfeit their rights and are subject to disciplinary action including, but not limited to; Prompt removal, 1 on 1 chat to establish warnings with site staff, Temporary bans, and permanent bans. The moderation reserves the right to change punishments on a case by case basis.
That Cherp.Chat does collect personal data that includes, but not limited to; All IP addresses related to an account, time zones, and login dates and the user consents to the storage and non-commercial use of this data.
That the user is responsible for keeping up with updates both within the rules, guidelines, and any adjustments made to the user agreement, and agree to abide by the changes and all previous statements will still apply unless explicitly stated.
Cherp.Chat is not responsible for any database issues including but not limited to; Loss of data, data breach, and force ending/removal of chats. Cherp.Chat will cooperate with authorities if approached regarding the database.
All donations that are given to the Cherp.Chat team are final and will not be refunded. Upon request, recurring payments will be canceled. In the event a user receives a permanent ban, their payment will be automatically canceled. Cherp.Chat also reserves the right to decide the direction of the funds based upon the financial need presented.
The user will remain anonymous and agree not to encourage other users to break their anonymity, as stated in the rules on the Cherp.Chat site and official Cherp.Chat Tumblr.
The user is not permitted to post chats publicly without the written and explicit permission of the other chat member. They agree that if a complaint is received regarding such behavior under any circumstances, they are subject to disciplinary measures.
That Cherp.Chat, reserves the right to perform “data sweeps”, using keywords to locate serious offenses and any offenses found during these “sweeps” will be treated as though it were an official report and the user consents to this. The user also agrees there will be no intentional attempt to avoid the “sweeps” and instead will be subject to disciplinary measures deemed appropriate by moderation.
The user registered and in contact with the site is above the age of 18 when the account is created and agrees to be investigated and able to provide a reasonable confirmation(s) of age upon request.
Cherp.Chat complies with the General Data Protection Regulation (GDPR), and if prompted so, will comply with user requests exercising their rights within the GDPR. Cherp.Chat is not responsible for private copies held by individual users for any reason. The user acknowledges within this agreement that there is no accountability held by the Cherp.Chat staff and will need to pursue a user directly if there is an issue.
General users acknowledge that they are not entitled to the information of other users. This includes, but is not limited to; Time Zones, usernames, previous posts, or connections. The user acknowledges that by demanding said information and any information deemed by the Cherp.Chat team to be inappropriate they will be breaching the agreement to remain anonymous and will receive disciplinary action. A “General User” is defined in this context to be any user that is not part of the staff and/or has not taken the agreement of NDA of the user’s information that is presented by responding to reports.
Cherp.Chat reserves the rights to deny any disciplinary appeals on a case by case basis and that disciplinary appeals are not required. The user also agrees that, when confronted with evidence deemed as truthful to their knowledge, Cherp.Chat holds the right to administer punishments. This is included, but not limited to; logging into another user’s account for any reason, sharing private chat information on separate sites, and attempting to locate users off-site for any reason.

The staff of cherp is not responsible for users actions, and all rules in place are a preventative measure out of worry and we are not to be held accountable if the rules are broken by the user. By logging in and/or creating an account after 09/16/2020 it will be taken as you have agreed you read the following statements. You also agree that any questions you have will be brought to the staff BEFORE any punishments are handed out as ignorance will not be a valid defense. By logging in you agree to the following list:

You read the rules that are on the site itself or the Tumblr, and agree that you understand them and have asked any questions you have. (Also that we aren’t sponsored by Tumblr or any company associated with them.)
You read the tagging guidelines that are on the site itself or the Tumblr, and that you understand them and have asked any questions you have.
That you read the Code of Conduct and agree to abide by it, as well have asked any questions you have to the site staff.
That you agree that by breaking any of the above statements you can be punished in ways that are, but not limited to: having a prompt removed, a private warning, a temporary ban or even a permanent ban. We can decide punishments on a case by case basis.
That we have a record of the following data that is, but not entirely limited to: IP addresses from devices you use for your account, timezone, and log in dates. These will not be distributed or used in any way off-site outside of the functionality of the site and the userbase and you’re okay with it.
It’s on you to read the rules, guidelines, and agreements whenever there is an update. There will be announcements of changes, and you agree that you read them as they come out and will abide by them. (You know, in case I made some dumb spelling error or something).
If the server or database takes a large nap for any reason, and we lose some data, we will try our best to recover it for you. If this nap and/or data loss is the result of an intentional breach from an outside source, they will be responsible for damages and punished appropriately. Stuff happens and we can’t predict everything, and will do our best to recover from it and make it as painless as possible for users.
Donations are just that; donations. There are no refunds and no expectation of direct benefits outside of the goals listed, and that if you want to cancel a recurring donation, you will get ahold of us and we can cancel it for you. If you are permanently banned, we’ll automatically cancel your recurring payments.
You’re here to be anonymous and will stay that way and won’t give any reason for a user to be able to recognize you, or make any attempts to have a user identify themselves. This isn’t social media.
Unless your partner agrees, you won’t post your chats anywhere. They are entitled to half of it just like you. If they find out that you posted it somewhere without their written permission in the log and they bring it to us, you’re open to any punishment moderation sees fit.
That we can do these things called “data sweeps”. Basically we search keywords in the database to ensure there is no shady business going on ooc and that you’re okay with this. If we find out you’re doing shady business, we can treat it just like someone bringing us a report, as well as will be punished if you’re caught intentionally trying to avoid them. It won’t stop us, just make us angry.
That you are over 18 when you make your account. If we think you aren’t we can launch an investigation and request a form of ID to confirm the age within reason. If we cannot confirm age or you are underage, that’s the chopping block.
We are pretty tight with this thing called the General Data Protection Regulation (GDPR). Basically, if you want your information deleted, and make a FORMAL request we’ll delete it. But! If your chat partner saved your chat together or something, we have nothing to do with the copy and if it comes up somewhere you can’t blame us since it has nothing to do with us.
You aren’t entitled to know about your partner. This means you don’t need to know why they are banned, why they’re taking a break, their username or anything like that. You can’t go out of your way and ask. That’s their business, just chill for a bit. If you aren’t part of staff, you aren’t allowed to really know any of this stuff and if we find out you’re trying to, we won’t take too kindly and might have to treat it as a report.
We are not required to give you an appeal to any sort of punishment we hand out. An appeal is a privilege, not a right. If you come into our inbox or dms acting out and slinging insults, we don’t have to do anything. You also agree you will ONLY log into your account. If we catch account sharing that’s not allowed, as it will skew user data, you’ll be punished for it as moderation sees fit.
