Warning, this got long, went on a bit of a rant, essentially we need to be better with our music copyright laws (in the US, as I'm not aware of the copyright laws in other countries as much), this boils down to if we can show that music all has connections and that a lot of music will have small chord progressions or lyrical segments that are the same or similar and that short pieces should not be able to be copyrighted like that as it would be similar to copyrighting specific tropes in writing
I feel like these famous musicians who keep getting sued for non-sampling related copyright issues (as in they are not sampling someone's song and calling it good, but instead are being sued because of small segments of chords or lyrics that sound or are similar (or realistically even if they are the same)) would potentially benefit from hiring some people to go through and listen to music and record/write down/document/etc. All the instances in music where a part in one song are similar/the same as other songs
Like examples of this aren't hard to find, but if you are looking you could potentially connect a significant amount of music to other music and would likely result in a better understanding in the music industry of what actually qualifies as copyright and would help them stop wasting time and money on that shit
And look, I know a lot of these artists being sued are wealthy and can afford to waste that time and that many people believe the little guy is being screwed over or something in these cases, but if you actually look at these cases they largely seem like money grabs and a lot of them should be dismissed outright, but seem to not be because there is a lot of fuzziness (it seems at least, because to me this seems pretty basic) surrounding copyright laws, not only because these lawsuits are wasting time and while I'm sure people are like "well, lawyers and judges and court employees need stuff to do so why not ¯\_(ツ)_/¯" the reality is that literally should not be the concern, because this has to do with an important aspect of copyright law
As stated earlier, these lawsuits I'm seeing (and am specifically referencing here) in the news typically have to do with short segments of chord progressions or similar lyrics in small segments or a similar chord progression with similar lyrics in small parts
I specify small because these instances don't seem to last longer than a few seconds at a time throughout the song (if that), and that is some fucking bullshit. Like, unless significant amounts of a song are plagiarized (and I'm talking like whole parts are exactly the same in the same exact way with literally no change or potential that it happened accidentally) I firmly do not believe that should be plagiarism or part of copyright laws (again I am not talking about sampling where they take the original song and remix it into their song and don't provide any credit at all even though they literally just adjusted some levels or some shit, that is a whole other story and is definitely a copyright issue)
Saying that small parts of songs that are the same or similar is copyright infringement is like saying that an author using the same trope as another is copying infringement or that basic concepts are and is an incredibly dangerous and slippery slope especially because it logically makes no fucking sense, if people weren't able to take pieces they like from some music and use it to write a whole new song then our global pool of music would likely shrink drastically and if one of these lawsuits managed to make it's way through the Supreme court (gods help us if that happens because the supreme court agreeing to hear one of these case because that would literally be so fucking ridiculous and idiotic, and I'm mentioning it here more for worse case scenario effect) it would drastically change copyright law and would likely result in a sharp decrease in music as people would rapidly run out of chords, lyrics, etc. To put together that wouldn't apply in some way to the work of another and would be a huge fucking nightmare to manage as the rich would likely rush to copyright all the lyrical verses and chord combinations possible to force others to have to pay them to create more music
But also consider this, the reality is that people are not all fucking stupid, and there usually is a judge they'd see (ideally long before it got close to that point at all) that is going to realize that it's bullshit and call them out on it, and again if they don't the chances of the supreme court agreeing to hear a case based on a few seconds of a song are slim, so what is the fucking point?
For the people filing these lawsuits it seems that they hope to either get a settlement or that they get a stupid judge and it becomes not worth it to the artist to continue to fight them on it, and again that is fucking stupid and shouldn't be allowed, like people talk about frivolous lawsuits in America and then bring up completely valid cases that large corporations convince you aren't valid because they want you to think it's just bullshit and then completely miss these cases it seems (or ignore them because they hate/dislike the artist involved and want them to get punished for it) (For those of you who don't know, the woman who sued McDonald's over hot coffee is often brought up as a frivolous lawsuit due to McDonald's propaganda that doesn't want you to question why a spilled cup of their coffee gave an elderly woman severe burns that resulted in a ton of medical bills) these are the actually frivolous lawsuits and they set their own dangerous precedents even in cases where the artists settle or eventually give up or whatever because it convinces other people they can do the same and it is a slippery slope before rich and famous artists (or more likely the greedy record companies that control a significant amount of this) will eventually start insisting that artists that are up and coming are copying music that belongs to them and it will limit what songs can be made and who is able to make them (it will be used to keep minorities out of the music industry along with those who have ideas the music industry doesn't want to support in a way that is even more severe than it is now)
Which brings us back to my original point, hiring people to compile the music that has similar or the same elements to show that there is significant precedent that something like that isn't copyright, potentially even forcing clarity into the law that would specify how much of a song has to be copied before it is a copyright issue because that clarification will put a full stop to the frivolous lawsuits of this nature and allow a focus on actual cases of copyright infringement while also setting up protection for all artists in the industry because the way this is heading with this shit, musicians aren't going to be able to listen to the radio or really go out in public at all for fear that they may accidentally hear part of a song in passing, not remember that they heard it and then came up with a whole new song that included that small piece they heard but don't remember hearing and that is simply ridiculous
For those of you who don't know, there is a belief that there are only 7 original stories and that the rest are just based on them and as a result there is a decent amount of leeway with storytelling as a result and we need to acknowledge that in the end music is essentially the same
Yeah you are going to get sued if you take someone's story, change the names, and try and pass it off as your own (and I'm talking word for word exactly the same except the names or at least huge chunks of it that have essentially been copy and pasted) but you aren't going to be sued because your story has a similar scene or plot or a character with the same or a similar name or whatever unless the original author is particularly stupid, vengeful, and mean because again the writing industry has been forced to be clearer about this (and yes there are still problems with it, but it's still better than the way the copyright laws in the music industry are going) and these are essentially equal comparisons as small segments of music are essentially tropes and archetypes and themes and whatever else within the music and we need to adjust to that fact and stop acting like every song is some completely original piece
There needs to be pressure to force clarity on this or it will become a shit show as capitalism consumes it
