- your employer is LEGALLY REQUIRED to pay you overtime (1.5x your typical wages) under the 8/44 rule (over 8 hours a day or 44 a week) unless formal negotiations have been made for ALTERNATIVE PAYMENT (ex. paid time off). your employer CANNOT reduce or eliminate overtime pay. your employer CANNOT choose to only abide by half of the 8/44 rule. your employer MUST pay you in accordance with the greater number of overtime hours you have worked in a week under the 8/44 rule. tips and other gratuity do NOT count as wages, overtime or otherwise.

- your employer MAY NOT work you for over 12 hours at a time unless they have received LAB1186, a permit for extended hours of work, from the alberta government. active permits can be viewed via a public government database, and your employer MUST show you a copy of their permit if you are being asked to work over 12 hours in a day. if they do not possess this permit then working an employee for over 12 hours at a time is ILLEGAL.

- it does not matter what is in your contract if your contract itself violates the law. a clause in a contract which stipulates extended work hours without a permit, reduced or eliminated overtime, or pay under $15/hour is NOT legally binding.

- your employer CANNOT terminate your employment for pointing out or leveraging any of these things either within the company or by reporting violations of the labour code to the alberta government.
