Policy on Explicit Artwork & Underage Characters
This post is to clarify Pillowfort’s position on sexually explicit visual art, particularly art containing minors. We apologize for not clarifying our position on this earlier; we have been working on revising the ToS to address these issues, but an incident arose today that necessitated us taking action on this matter, so it seems necessary to put things in plain terms now.
As of this statement, Pillowfort will not allow explicit visual art of characters that appear to be underage. Now, due to the inherently subjective nature of trying to determine the age of a fictional character in a stylized medium, the “gray area” cases will be up to the discretion of the moderator reviewing the content. Broadly, if your characters are close to 18 and could plausibly or arguably be of age based on appearance, that will be allowed. We are not going to comb through the wiki of a particular fandom to try and find the canonical age of a fictional character and then try to figure out if the character in the art piece is supposed to be represented at their canonical age or not. Similarly, many works of art contain sexual activity as a theme of adolescence and coming-of-age– I’m sure you yourself can think of many movies, shows, etc. you’ve seen that featured underage characters in a sexual relationship, some even explicitly– and even if you wanted to argue that art that explored adolescent sexuality was fine and it’s ‘just pornography’ that should be censured, we aren’t going to be the arbiters of what is art vs. ‘merely’ pornography. Therefore, sexual depictions of characters in later stages of adolescence may broadly be considered ‘safe.’
However, any explicit or sexual art of a character that appears to be physically pre-pubescent or barely pubescent (i.e. not plausibly or arguably of age, or even close to it) will be prohibited. We realize this decision may anger some people, but we have devoted a considerable amount of thought to this decision and we feel this is the best approach for our community.
Importantly, we don’t want people to worry that this heralds a broader ban on ‘problematic’ content. When it comes to fictional depictions or descriptions of divisive subjects such as incest, rape, abuse, etc., we do not intend to restrict that content, for largely the same reasons as discussed above with regards to ‘gray-area’ underage content. We understand these subjects can be distressing for many, and we do request that people posting content that is potentially upsetting tag such posts with the relevant terms so that it can be avoided by those who don’t wish to view such content. The only situation we foresee penalizing the posting of this content would be a case already covered in our ToS, where a bad-faith user appears to be intentionally spamming completely unrelated tags or communities with violent or sexual content with the intent or result of disrupting the usual functioning of that tag or community.

If you are willing to ban one thing because you moralize fiction, there is no tangible reason I can think of that you wouldn’t end up banning these other fictional things when the concept itself is obviously immoral. Underage stuff is bad irl, obviously. So is rape. Why are you making exemptions for one and not the other? Why should a user feel safe posting the TOS acceptable content of, say, abuse if you’ve already made it clear that you’re willing to ban something for being irl-wrong?
You’re getting a lot of traffic and a lot of money from people trying to flee tumblr’s new wave of puritanical banning, and this is a massive red flag that you could do exactly the same thing. Why? Why should we trust you? Why shouldn’t the people who paid for invite codes before you stated that you would be banning content in a fandom space that could, reasonably, include harry potter erotica?
I’m side-eyeing all the kids in the notes mocking people upset by this, and I have to say to them all, if you believe that content restrictions are going to stop only on things you dislike and not soon start infringing on, say, perfectly legal-adults porn, survivor support groups, and queer content, I have a bridge to Terabithia to sell you. @pillowfort-io this is very, very disappointing. These kinds of ‘grey areas’ only leave openings for harassers. So many artists were looking to your website to protect them from false accusations of pedophilia like they endure here, but I can see that will not be the case.

@scofflawsins I’m a bit confused here, what’s the alternative to having “grey areas?” Not every fanart of a character comes with a canonical age, there has to be some interpretation involved, and at the very least they are confirming it’ll be checked by a human and not a bot. I certainly agree that there should be as little room for harassers and cp as possible, but if you don’t mind me asking, how would you suggest modifying this?
Specifying “underage” would be a good start, for one. It seems reasonable on the surface to say “okay, no underage pictures on the site” before you think that 99% of the non-marauders era Harry Potter ships would be underages. Are they just going to... not allow harry potter erotica? Buffy from the first season was underage. Everyone but the teachers in BNHA is underage. They’re saying “barely pubescent” which can be as high as 16 or as early as 10.
But the thing is... that doesn’t really matter? CP is not the same as underage. CP is child porn. Real people. Real, actual victims. imo, the way I’d want to see this moderated is for it to not be. Maybe require people to tag it, but don’t ban something outright like this. Look at AO3- they permit underage characters in explicit situations, because they realize that comparing actual child porn and harry/draco pwp is offensive. Comparing real victims of CSA to fiction is honestly horrifying, it’s saying “the thing that you went through is the same as this at-worse triggering material”.
The way communities are set up on pillowfort, you can have individual communities with rules against underage stuff if they want to, and individuals that post that stuff? You don’t have to follow them. These sites are there to curate what YOU want to see, and setting these rules down automatically creates an avenue for harassers that they shouldn’t have to begin with.
Let people do whatever the fuck they want in fiction. It’s not real.
