Double Jeopardy|| Toby and Leroy || V8 W1 || Friday Morning
âWeâll go with that,â Leroy huffed, sitting back in the chair. Of course, he didnât like Specials. But he didnât have anything against them, and frankly, Shelbyâs plans seemed to make his hobby a little harder to do. If all the Specials go and get registered, then it will be on record when they go missing. âSo, doc, whatâre you thinkinâ. The charges easy to make go away?â
âWell you donât like making my life easy-â Toby sighed, going through the evidence for a final time before looking back up at the other man with a nonchalant shrug. There was loophole upon loophole that theyâd be able to exploit with this one, not to mention many ways they could sway the jury, should it even come to trail. Which with this flimsy evidence, was unlikely. âDonât worry Mr. Crouch, no need to get your affairs in order just yet.â

âAw, come on!â Cole crossed his arms and grumbled, hardly believing that after making the wonderful discovery that he could go wherever he wanted, his dad was immediately thinking politics. Not that he could really blame him, what with everything going on. âSo youâre not gonna do anything with it at all?â
Toby could see that look on Coleâs face, the disappointment, the confusion. But just because the first thing that Cole did when he realised he had a power was run around seeing who else had superpowers, didnât mean he had to as well. âNot a damn thing.â He clarified, stating it so plainly that Cole would be unwise to try and argue. With the current political climate surrounding Specials, outing himself right now would be insane. No, what he needed was to keep this unfortunate part of his life as secret as humanly possible. At least until people around settled down on the topic. Who knew how long that would take, so for now, heâd stick with the secret idea. It would be difficult, of course it would, but, so long as Cole and Eleanor helped him out, he should be able to continue his work unhindered. âSo. Are you going to teach me to control this or not?â

Cole just kept on grinning, watching his father with curiosity, wondering if heâd do it again. âIâll reiterate-â He started âPowers are weird.â Thee wasnât really much more to it; they worked differently on different people, manifested at different times in lives. Perhaps his power had been waiting for a spark to set it off for years, but since his dad never did anything interesting, the ability must have just gotten bored and started up anyway. âSo you gonna take a holiday or something? Itâll at least make your commute to work a lot quicker.â He started speaking quickly, excited by the possibilities presented by his fatherâs new-found ability.Â
âNo. No, no, none of that.â Toby shook his head and immediately dismissed Coleâs ideas of ever using his new power for his own gain, or in any way that might lead other people to become aware of it. So far as he was concerned, nobody but himself,Cole, and Ellie would ever know what he could do. âI canât risk loosing clients due to this. And donât you tell anyone, either.â Toby warned his son, turning to him with a parental look in his eye that clearly said donât you dare.
Father Known || Avery & Toby || V8 W1 Friday Afternoon
âNo, I supposed we canât.â Avery mused, pursing his lips in a disapproving manner. Â He didnât like the similarities that Toby was pointing out now, probably hated it more than the other man poking around in his family business. The idea that he was like his father, even if just a little bit, made Averyâs skin crawl.
He snickered slightly, looking over at the man with his head canted to the side, a look of curiosity etched on his face. âEnough about me and my father.â Avery was done talking about the old man though planned to use this time to find out more about the one sitting across from him. âWhat about your family? Iâm sure youâve got some? Or am I mistaken?â
A lesser man may have found satisfaction in seeing the younger man appear visibly irritated. Not Toby though - he simply noted it, swallowed whatever guilt he may feel from being so terrible at holding amicable conversations, and moved on. Apparently it was his turn now to talk about his family, though he couldnât see why Avery would have much interest in that. Perhaps he was just trying to change the subject.Â
âNot mistaken.â He said, a tight smile on his lips. âI myself have two children. A son and daughter, around your age, Iâd guess.â Toby stopped himself from saying more, unsure on exactly how much he should share about his family. Should he say that his children probably feel the same way about him as Avery does his father? "Couldnât be more different if they tried.â

Cole would complain about his fatherâs attitude, if he wasnât completely aware that heâd been the exact same way hundreds of times. He waited patiently for Toby to comply, watching with great interest. Though he didnât know what was going through his dadâs mind, he could see him visibly relax and breathe slower. Then suddenly his dad was nowhere to be seen.Â
Hearing the curse behind him, Cole span around, an enthused grin etched on his face. âShit, dad. Thatâs so cool.â
âDonât swear.â He said absentmindedly, walking back into the middle of the room and grabbing his beer again. This was just. âWhy would it choose now to manifest?â He asked, genuine confusion and frustrated and about a thousand other emotions. âYou and Ellie, why would yourâs start so early and mine take so long?â

As per usual, Cole was home alone, enjoying the freedom that came with being fifteen and by himself. Though his father and sister had been invited to some fancy dinner thing, apparently Cole was something of an embarrassment in those crowds. Not that he minded at all, since it allowed him his independence. His motherâs music was playing fairly loudly and there was a big bowl of sugary cereal sitting in front of him on the table. Were he a traditional teen, heâd have a big party, but the risk of his dad coming home early was too great to dare. Not that he minded, given how many parties he went to out of the house.
Just as Cole was downing his fourth bowl of cereal, he heard the door click and watched as his sister stormed to her room and slammed the door. Another great night, apparently.
The journey home had been just as awkward as most of the night, and it was no surprise that Ellie went straight to her room. It wasnât his fault, technically. Although he probably shouldnât have agreed to go out that night, knowing how low he was feeling at at that point. And it was a good idea really that heâd gotten out of there as soon as they had, even if Eleanor had wanted to stay a lot longer. And to make things worse, Cole was playing that damn music again.
âEvening, Cole.â He grumbled, immediately walking over to the record player and flipping it off. After that, he went to the kitchen and poured himself a drink, having every intention to drink himself to sleep and ignore everything until this cloud passed - his kids were old enough, they would be alright without him for a couple days, surely.Â

Cole sighed, leaning back in the chair, listening to his dadâs resistance to acknowledge the incredible thing that he could do. âIf you donât try and practice then itâll just happen again.â He said, resigned. âI mean, if you want to just randomly teleport places, go ahead, but you might as well try and control it.â
Grumbling, Toby acknowledged that Cole was actually right, and that if this was a thing he was going to have to deal with, then he might as well deal with it properly. He mummered âFine.â and put his beer down - though took another swig beforehand, lord knows he needed it. Closing his eyes, Toby breathed slow and tried to recreate how he was feeling in the office earlier that day. He pictured the other side of the room, how the carpet would feel underneath his formal shoes. He imagined how the slight draft from the window would feel against his cheek. Then opened his eyes.Â
Sure enough, Toby was there on the other side of the room, looking at the back of Coleâs head. âBloody hell.â Was all he could think to say.

Again, Cole shrugged and finished off his beer. What more could he say? If there was no real reason for it to manifest, then his dad was right - this was just an anomaly. âI mean, itâs probably a power⊠have you tried to do it again? You should give it a go, just to be certain, you know?âÂ
âDo it again?â Toby looked up at his son with an exasperated expression. âI would much rather forget that it ever happened completely.â Technically he knew heâd have to acknowledge it at some point, but heâd rather put it off for as long as possible. Toby stood up and went to his fridge and grabbed himself a beer, figuring this was too hard to deal with sober. âBesides, I wouldnât even know how to.â

Shit. Not that he presumed that Cole was the be-all-end-off knowledge on powers, but given that there was no one in the room when it happened, it was incredibly unlikely that it was somebody else. Ignoring the smirk on this younger manâs face, Toby interlocked his fingers across his chest and thought for a moment more. âTeleportation⊠Why on earth would it choose now to start happening? Seems a little out of the blue.â
At his dadâs question, Cole could only shrug. âPowers are weird.â Not the most eloquent answer, and certainly not something his father would be satisfied with. So Cole sighed and tried again. âSometimes thereâs gotta be a thing that, like, jump starts them, you know? I mean, has anything happened recently?â
"Powers are weird." Toby mused on that for a second, discouraged by the simplicity of the statement. Though he probably should have expected this. As Cole explained further, it was Toby's turn to shrug. "Nothing I can think of, I don't exactly lead an exciting life, Cole." He explained, really trying to remember anything interesting that could have sparked his power into motion. "It would appear I'm simply an anomaly. If this is my ability, that is." Toby said, still with a modicum of hope.

Pursing hi lips, Cole considered other possibilities. It wasnât hard to see that his father wanted nothing to do with abilities, but from the sound of it, the old man was going to be disappointed. âUh, yeah, that, I mean, I canât think of anything else it could be. Unless there was like another teleporter around you that knew where you lived⊠Which is unlikely.â He shrugged, swigging his beer and leaning forward in the chair. âBut Iâd say you gotta entertain the possibility you got an ability, sorry, Pop.â There was a slight smirk on his lips, he couldnât help it. His dad suddenly developing a power, for some reason, made him want to laugh.

Cole was in the middle of grabbing himself a drink when he realised what his father said. He was blunt as ever, but that probably helped. âOh.â What else was he supposed to say? He didnât for one second think the old man was joking - that wasnât his style. Taking a swig of the beer he found in the fridge. Cole slowly walked over to the chair opposite his father. âOkay⊠What uhâŠ. I mean⊠what happened?â He asked, not entirely sure what he was supposed to do with this information. âYou think you have a power?â
âWhat happened was-â Toby sighed and rubbed his eyes for a moment, only feeling somewhat stressed about the whole thing, and trying ever so hard not to take it out on Cole - after all, he needed his help in understanding it. âI was sitting in my office, and then I was sitting at here. Poof. I thought about it, and it happened. Just like that.â He paused, trying to think if there was anything more to his story that he should tell. Deciding that, no, that was about it Toby looked up at his son with a concerned expression. âYou think itâs a power? Surely thereâs something else that it can be?â

As soon as heâd gotten that text, Cole dropped what he was doing - which was nothing - and headed out for his fatherâs apartment. Regardless of what the problem was, he felt as though it was his duty to go see to it.
It was a quick enough walk, and before long, Cole was standing in front of the door. Should he knock? Should he just go right in? Should he do both? Both sounded good. Cole opened the door, knocking on it at the same time and peered into the apartment. âHey Dad, just me.â He called, taking a step inside and quickly noticing the older man sitting his favourite chair. âWhatâs up?â Walking further into the apartment, Cole looked at his dad and noted how shaken and pale he looked. âAre you alright?â He asked moving closer and lowering his brows.
The knock at the door startled Toby, enough to make the cat jump from his lap and hide somewhere else in the apartment. âCole.â He greeted the young man without getting up, not trusting his legs to keep him standing. âGet a drink, have a seat. No Iâm not okay, but thatâs alright, itâs why youâre here.â Toby spoke with a fairly clinical manor, only glancing up at Cole a couple of times. He wasnât a massive fan of big emotional heart-to-hearts, so instead, he stared straight ahead and said what was on his mind. âI teleported today. Or I blacked out and walked home. It was probably the first thing though.â

Hands shaking, Toby tried sat absent-mindedly stroking the cat on his lap. Just because he happened to one time magically teleport across the city didnât mean it had been something heâd done. No it was something different⊠It had to be. Maybe heâd been day dreaming or someone different had moved him or⊠Toby shook his head and breathed slowly. There was no point getting worked up about it. Cole would be here soon, heâd know what it was. Probably. Or Cole would have no idea and heâd be back to square one⊠Nervously, Toby just kept petting Cabbage, waiting for his son to arrive.
Headcanon
Toby has suffered from depression since he was a teenager. He takes pills for it, but occasionally he has down periods.
Edit:
He doesn't have any medication in the PU, and so his alter ego suffers quite badly with it.
