Much work on early women’s prisons reveals both (i) how they enforced the gender binary and (ii) how misandrogyny can be mutually reinforcing with misogyny, White supremacy, and class domination. Angela Davis characterizes AFAB convicts in a way that resembles Lori Watson’s remark that presumed AFAB GNC folk are seen as “failed women”: “According to dominant views [during the nineteenth century], women convicts were irrevocably fallen women. . . . [F]emale criminals were seen as having transgressed fundamental moral principles of womanhood.” Prison reformers didn’t challenge the idea that women convicts were fallen women but that they were beyond redemption. As a path to redemption, reformers proposed prisons that would push criminalized AFAB persons to assimilate to White, middle-class domestic roles. Reporting on a prison described by Elizabeth Gurley Flynn, Davis says their regimes were “based on the assumption that ‘criminal’ women could be rehabilitated by assimilating correct womanly behaviors—that is, by becoming experts in domesticity—especially cooking, cleaning, and sewing.” As Joanne Belknap put it, “[A]n important role of the reform movement in women’s prisons was to encourage and ingrain ‘appropriate’ gender roles, such as vocational training in cooking, sewing and cleaning.” As institutionalized mechanisms of assignment, such regimes pushed AFAB persons into binary feminine gender roles.

I want to add to this interesting discussion of female criminality & misandrogyny, the long history of transmasculinity being associated with sexual promiscuity and sex workers, & how pornophobia intersects straight through this connection.

The first waywardism laws in New York State start in the 1880s and they only apply to girls and women, originally ones who are arrested for prostitution and then expanded greatly in the late 1800s to women who might become prostitutes. And that's where they really get into danger, right? Because suddenly the charge of prostitution has nothing to do with sex work or exchanging sex for money. Instead, a wayward girl is anyone who was thought to be improperly feminine to the point where she has an invitation to prostitution. She's either too sexual or she's too masculine and unable to get any other kind of job. So of course she's going to end up being a prostitute.

This does not even touch on the role psychiatric institutionalization has always played in the policing of people classed as women's gender non-conformity:

In October 1890 a judge sent Dick/Mamie Ruble to the state insane asylum because of “a hallucination that she should wear men’s clothing and wants legal authority for doing so.” Ruble was arrested for violating cross- dressing law, but the case took a dramatic twist in court, when Ruble refused to identify with available gender categories and explained to the judge, “I’m neither a man nor a woman and I’ve got no sex at all.” While many cross- dressing offenders pled for mercy and claimed their crimes were innocent “pranks,” Ruble challenged the judge to locate femininity on his/her muscular body: “Did you ever see a woman with a hand like that Judge . . . ? Look at that muscle. Oh I tell you I couldn’t pass for a woman anywhere, even if I tried.” Unimpressed by Ruble’s declarations, the judge called in the police surgeon, who referred the case to the Insanity Commission, located in a small basement room in city hall. The two-member commission reviewed the case, declared Ruble insane, and ordered his/her indefinite commitment to the Stockton Asylum, where the admitting doctor noted that Ruble “imagines she is a hermaphrodite. Wears male clothing. Wishes to have legal authority to wear men’s clothing.” Such “evidence of insanity” doomed Ruble to life in the asylum; s/he remained there for eighteen years, until dying from tuberculosis in 1908. [...] Similarly in 1899 the commission found Sophie Lederer to be insane, noting that the twenty-three-year-old domestic worker “talks irrationally— acts silly and claims to be a boy.” Pohlmann spent two months in the Stockton Asylum before being deported to Germany, while Lederer effectively received a life sentence, dying in the asylum of heart disease in 1908.

For an untold amount of people seen as transmasculine in the 19th and 20th century, getting caught could mean being accused of being a prostitute and being sent to a woman's prison where you would be forcibly cisfeminized through domestic labor (and very likely some degree of sexual assault) OR you are found to be insane by virtue of your perceived transmasculinity and given a life sentence in an asylum (and very likely subjected to some degree of sexual assault).
