What is up with Dylanns case?

He was granted an extension to file a petition for a writ of certiorari until April 12th 2026. Which has passed, it is unknown if him and his legal team made a filing. But it is likely they have and we will know soon.

What does the writ of certiorari mean in this context? It is a petition to ask the U.S supreme court to review the lower court’s decision. This is a critical and often a final step in the post conviction review process.

What is to be expected? You can expect a response likely this year. It is very unlikely it will be granted.

What does a denial of the certiorari mean for him? It will likely mean for him that the death sentence is final. Which means that he will have exhausted his main appeals, and any further appeals he files are not a shield to protect him from a date of execution being set. So he can still make emergency appeals, but they don’t act as a shield against a date being set once his death sentence is finalized. So that means the DOJ could set a date if his certiorari is likely denied.
