Smith v. Wal-Mart Wal-Mart Attempts to Stop “Walocaust” Items From Being Created Smith, a Wal-Mart critic, created t-shirts and mugs with the word “Walocaust” on them. Wal-Mart asked Smith to cease creating these items and argued that it was a violation of its trademark right. The ACLU of Georgia filed a lawsuit on Smith’s behalf and asked the court to clarify that Smith has a right to make these items. In response, Wal-Mart countersued Smith and asked the court to ban Smith from making anymore “Walocaust” items. Included in Wal-Mart’s countersuit was a request for damages that they claimed were necessary due to the diminished reputation Wal-Mart alleged it suffered from Smith’s items. Eventually the case was brought to the Court of Appeals for the Eleventh Circuit, where the Court found that Smith's products were successful parodies of Wal-Mart's trademarks and therefore were protected from trademark infringement or trademark dilution claims. The Court granted Smith summary judgment as a result.
Walmart abandoned the #WalmartElves trademark in July but are still trying to censor us. There is no way anyone visiting this blog would confuse this blog with Wal-Mart. The United States Patent and Trademark Office clearly shows that Walmart abandoned the trademark. On October 26, 2015, we got notice that Walmart's lawyer complained to the domain registrar #WalmartElves on strike were using about a Trademark violation for walmartelves.com and walmartelves.org. The “Walmart Elves” trademark is a trademark Walmart abandoned after only filing for it AFTER the walmartelves.com domain was directing to this blog in 2012. The United States Patent and Trademark Office clearly shows that Walmart abandoned the trademark. There are a lot of documents here: http://tsdr.uspto.gov/#caseNumber=85850358&caseSearchType=US_APPLICATION&caseType=SERIAL_NO&searchType=statusSearch In 2012, Wal-Mart made Tumblr give them the url for walmartelves.tumblr.com The blog (formerly http://walmartelves.tumblr.com/ but now elvesonstrike.tumblr.com) was created to display art and parody in support of Walmart Strikers during the 2012 holiday season and has been relinquished to Wal-Mart because a lawyer from Wal-Mart demanded Tumblr hand it over.This lawyer representing Wal-Mart contacted Tumblr about the account http://walmartelves.tumblr.com/ on or around November 14, 2013 because the lawyer claimed it caused confusion and infringed upon the rights of Wal-Mart.However, - http://walmartelves.tumblr.com/ - was not an infringing Tumblr account when it was created. The URL walmartelves should not automatically belong to Walmart. This Tumblr was started on November 29, 2012, and Wal-Mart did not actually apply for and register the trademark "Walmart Elves" until February and April of 2013. This trademark filing information is included in the attachment the lawyer sent Tumblr (read it here: https://www.scribd.com/doc/185092030/11-14-13-Ltr-to-Tumblr-Re-WalmartElves-Exhibits). The Tumblr url, which was given to Walmart was not infringing upon them when it was created. Also, the Tumblr account was not causing confusion. There is no possible way anyone would have thought the content we post on here was created by Wal-Mart.Moreover, attorney Gary J. Rinkerman misrepresented the extent to which Wal-Mart used "Walmart Elves" as a hashtag and brand personality in 2012. Walmart uses the hashtag #WalmartElves to violate Twitter's terms of service by spamming people with links to the Wal-Mart website. Spamming Twitter with a hashtag should not automatically mean a corporation can claim any blog it wants. Now Walmart appears to be taking steps to seize walmartelves.com. In the past, Wal-Mart has used its wealth to pay a lawyer to misrepresent Wal-Mart's use of "Walmart Elves" as a brand and have the http://walmartelves.tumblr.com/ transferred to them. Many of the posts on the Tumblr (which is now http://elvesonstrike.tumblr.com/) are posts which were reblogged from other accounts, which you can see if you review them. It is not fair for Walmart to be allowed to just take a blog because it decides it doesn't like its content. Allowing Walmart to use the http://walmartelves.tumblr.com/ Tumblr set a scary precedent for Tumblr. A corporation like Walmart should not be able to force Tumblr to transfer the url of a humorous artistic blog just because Walmart doesn't like it. This is a violation of the First Amendment. If Walmart seizes the walmartelves.com domain, it will set an even scarier precedent. Please tell everyone about this censorship of political speech on the internet and show your support for Walmart Strikers and Walmart Workers and people in Walmart sweatshops by Tweeting with the #WalmartElves hashtag and using it everywhere.
