Legal Metrology Certification
Customs authorities are becoming more stringent when it comes to the application of legal metrology requirements to enterprises in India. Under Section 19 of the Legal Metrology Act of 2009, no individual may import any weights or measurements without first obtaining an importer certificate. These certificates are meant to level the playing field for some or all manufacturers, importers, and packers.
Legal Metrology (Packaged Commodities) Rules, 2011 Applicability Every packer, manufacturer, and importer of pre-packaged goods must comply with the Legal Metrology (Packaged Commodities) Rules, 2011. According to these regulations, they must receive a certificate.
In the following situations, the aforementioned provisions do not apply:
1. Commodity containers containing greater than 25 kg or 25 liters in weight.
2. Packaged goods intended for institutional or industrial consumers.
3. The sale of cement and fertilizer in sacks larger than 50 kg.
Both the State Government and the Central Government have the authority to give registration. The applicant can apply to the state government for the certificate if he intends to sell the pre-packaged good in just one state. However, the applicant must apply for registration with the Central Government if he intends to sell the pre-packaged product in more than one state.
Each maker, packer, or importer of a pre-packaged product must submit an application in accordance with Rule 27 of the Legal Metrology (Packaged Commodities) Rules, 2011. The Legal Metrology Application in India must be requested within 90 days after the importation's start date. A person or a firm that produces, makes, or manufactures a packaged good is referred to as a manufacturer in this context. This definition also includes a person or a business that places, or causes to be placed, a mark on a packaged good that was not produced, made, or manufactured by them or their business and that claims the good inside the package was produced, made, or manufactured by that person or business, as the case may be. A packer is someone who,
1. The manufacturer's name and address, or, if the manufacturer and packer are different, the manufacturer and packer's names and addresses, or, in the case of imported goods,
2. The importer's name and address, must be given.
3. The product's common or generic name.
4. The product's net quantity in the package.
5. The month and year that the product is made, imported, or is pre-packaged.
6. The product's Maximum Retail Price (MRP).
7. The commodity's dimensions must be indicated when the product's size is important.
Certification of Importers
It is prohibited to import any weights or measurements unless the importer has registered with the Director of Legal Metrology in accordance with Section 19. The importer must make sure that the commodity's packaging includes all required declarations, such as the country of origin, the manufacturer's name and address, the importer's name and address, etc.
