In the United States right now, the Birthright Citizenship argument is making headlines again as Trump is petitioning the Supreme Court to start over and rule again on their recent decision to uphold the language of the 14th amendment as it is written. This is gonna be a long post.
Since the Supreme Court has made that ruling, conservative influencers, extremist far-right platforms, and some Republican politicians have expressed their disapproval dramatically in a way that suggests this is a new, unprecedented ruling that will fundamentally change the American way of life extremely negatively. In truth though, the ruling means that the same law that has been in effect for 160 years isn't changing. Nothing new, nothing different.
The clause in question, ratified in 1868, states: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."
The popular arguments are 1.) the amendment, written in the 1860s, was only in regard to freed slaves to guarantee their rights as citizens, and 2.) they don't understand the phrase "subject to the jurisdiction thereof" and are interpreting it to mean something it doesn't, usually something along the lines of assuming a non-citizen is only subject to the jurisdiction of their home country and not to the U.S. Neither of these hold any merit.
1.) The amendment was intentionally written with the phrase "all persons." While someone can maybe argue the amendment was motivated to be written in order to grant freed slaves their rights by establishing it in the Constitution, the phrase "all persons" was clearly used to be inclusive of everyone regardless of the status of their parents, or even regardless of if they themselves were born here if they're naturalized later. The word "all" doesn't have a double meaning, it means all. All persons, not just freed slaves.
2.) "Subject to the jurisdiction thereof" means that you are required to obey the laws of the country and can be prosecuted if you break those laws. People who do not have legal citizenship here, whether they're just visiting as tourists, in the process of legally immigrating, or are illegal immigrants with no path to citizenship, are all subject to the jurisdiction thereof when they are on U.S. soil.
That statement in the 14th amendment is saying that you are not automatically made a citizen only because you are required to obey the laws of the country; you are not a U.S. citizen just because you can get arrested and held in jail or prison, you must also be born here or naturalized.
It also means that you're not automatically made a U.S. citizen if your parents are U.S. citizens and you're born in another country; if your parents then bring you to the USA you are now subject to the jurisdiction thereof, but you weren't born here and you haven't been naturalized, so you are not a citizen of the USA (however, U.S. parents do have options to obtain citizenship for their foreign-born newborns, it's just not automatic).
At the moment there is no method or process where you are born in USA, or naturalized later, but are somehow not subject to the jurisdiction thereof. Currently the only way for someone to not be subject to the jurisdiction thereof when they're on US soil is to be a foreign diplomat and granted diplomatic immunity; if they break the law with diplomatic immunity they can be forcefully expelled and banned from entering USA again but we can't prosecute them in a court of law. That being said, if you are born here or naturalized later, and are also a citizen of another country, you are not allowed to be stationed in the USA as a foreign diplomat of the other country. So, currently, no matter what, if you're born here or naturalized later, there is no way to NOT be subject to the jurisdiction thereof when you're on U.S. soil.
The amendment does imply though that if that ever changes, if there is ever a point in the future where you can be born here (or naturalized later) but NOT subject to the jurisdiction thereof, then you would not be a U.S. citizen.

The United States Government listing "antifa" a terrorist organization and trying to prosecute people "for being a member" as if that makes any sense, is almost the same thing Russia did when it labeled the Anti Corruption Foundation as an extremist organization and arrested any journalist who tried to film Alexei Navalny's funeral or anyone who donated to them publicly. Their corrupt government was against the anti corruption group just like our fascist government is against the anti fascist group.

“The Department of Justice is investigating Gavin Newsom. Newsom found out, went on camera, and told Donald Trump he had picked the wrong target.
Federal agents have been knocking on doors for days, the governor said in a video posted Monday. Friends. Family. Former employees. They have demanded records and pulled what Newsom called years and years of random documents. The agents have not found a crime, he said. They are simply trying to find one.
The thing that put Newsom in front of a camera is what they are doing to his wife.
Jennifer Siebel Newsom is a documentary filmmaker who runs nonprofits on gender equity and the representation of women. DOJ is now examining her tax filings.
Newsom did not hide what he thought of that. "If they can't intimidate me, they'll go after the mother of our children," he said. "Donald Trump picked the wrong target."
The president has been working on a list.
James Comey, the FBI director who investigated him.
Letitia James, the New York attorney general who sued him.
Adam Schiff, the senator who led his first impeachment.
Jerome Powell, the Fed chair who would not lower interest rates.
Tim Walz, the governor he lost an election to.
Each of them has been investigated, accused, or harassed by the federal government since Trump took office, and each fits the same description: someone who got in his way.
Newsom is the latest. Last year, after the governor called out the Los Angeles immigration raids, Trump publicly endorsed the idea of arresting him. This year, his DOJ is reading the family's mail. Newsom is not pretending it is a coincidence.
"Donald Trump isn't just coming after me because of my mean tweets," he said. "He's coming after me because I'm considering running for president."
Reporting on the probe is complicated.
Career officials in California have told reporters the investigation traces back to whistleblowers and was not ordered from Washington. Newsom's office has filed a public-records request to find out exactly how the probe was opened. But it does not change what’s going on. A long list of people who have crossed this president are being investigated by his government.
The list keeps growing.
"You can subpoena my records, you can investigate me, you can harass me, put my name on every and any enemies list you have," Newsom said. "But leave my wife and family out of your personal vendetta."
They went looking for a crime. They found a candidate."
Ted Cruz just handed Democrats a gift, standing in front of a room full of billionaires, he admitted on camera that Trump Accounts are a backdoor scheme to dismantle Social Security.
At the Milken Institute conference in Beverly Hills this week, Cruz called Trump Accounts, the baby savings accounts created under last year's GOP budget law, "Social Security personal accounts," then added: "Here's the dirty little secret: Trump accounts are Social Security personal accounts."
This wasn't a slip.
Cruz spelled out the endgame: once kids grow up with these accounts, Republicans pitch parents on diverting their payroll taxes, the money that funds YOUR current Social Security into private Wall Street investment accounts instead.
His prediction: within five years, that becomes a "really compelling constituency."
Cruz isn't the first to brag about it. At a Breitbart forum last summer, Treasury Secretary Scott Bessent described the accounts as "a back door for privatizing Social Security."
And while Republicans were telling the public these were just cute little baby bonds, Axios reports the idea of replacing or augmenting Social Security with Trump Accounts has been discussed behind closed doors with lawmakers for some time, they just didn't want to "touch the third rail" publicly.
Now they're not bothering to hide it.
The strategy is two-pronged: build up Trump Accounts with one hand, and gut the Social Security Administration with the other, so when the agency collapses under DOGE cuts, they can point at the wreckage and say "look how broken it is."
Polling shows just 15% of Americans support privatizing Social Security. The other 85% better start paying attention.
They've been plotting this for 50 years. Cruz just told you exactly how they plan to finally pull it off.
Assuming his old age doesn't take its final toll on him, Donald Trump is going to run for a 3rd time in 2028 despite the Constitution and somehow miraculously win by a major landslide. Between his buddy Scott Leiendecker buying Dominion Voting Systems in October 2025 and now this, they're going to blatantly rig the election so obviously and for some reason no one is going to stop them.
