The arbitration decision was made before the SCC decided Johnstone; the Alberta court's decision suggests that the 'Johnstone test' is going to become a more permanent feature of the legal and HR landscape. Most worrying, and this was a failure on the part of the employer, NO consideration was given to the fact that the worker knowingly applied for the job, AND was aware of the shift schedule. Employers need to comprehensively demonstrate and defend their scheduling, showing that workers learn, in the hiring process, what their prospective employer will expect.
Today's study is just the latest word and must be interpreted in context of others.
