The Brazilian Senate has just approved Bill 2159/2021, dubbed the “Devastation Bill” — we still have margin to halt it!

I'll be succinct. It's a severe blow to not only the Constitution but to the environmental future of Brazil and the world entire.

Article 225 of the Brazilian Constitution is clear: Everyone has the right to an ecologically balanced environment. This right — essential to a healthy quality of life — cannot be trampled for the economic interests of the few.

This Bill:

Legalises “self-licensing” for medium-impact projects, bypassing proper technical environmental assessments;

Allows political bodies with no environmental expertise to approve high-risk projects;

Excludes Indigenous and traditional communities from decision-making, in violation of ILO Convention 169;

Completely ignores the climate crisis, even as Brazil prepares to host COP30;

Undermines the Paris Agreement, paving the way for new environmental disasters, like the Mariana dam collapse.

According to the Instituto Socioambiental (ISA) and the Federal University of Minas Gerais (UFMG):

The Ferrogrão railway project between Mato Grosso and Pará alone could cause the loss of 53,000 km² of Amazon rainforest by 2030 — an area the size of Croatia.

Paving the BR‑319 highway could result in up to 9,400 km² of deforestation per year, adding up to 170,000 km² by 2050. All of this would be worsened by the removal of the technical environmental checks currently required by law.

Now: President Lula still has the power to veto Bill 2159/2021. His decision will be crucial, not just for the future of the Amazon and traditional peoples, which, arguably, are the most important factor, but for Brazil’s climate commitments on the global stage.

The bill, which passed with a vote of 267 to 116, had previously cleared the Senate in May. So we cannot count on that body to veto: in full Bolsonaro style, it is complicit.

The proposed law effectively dismantles key components of Brazil’s environmental licensing regime. It consolidates the existing multi-layered approval process into a single step and allows a wide range of infrastructure and agribusiness projects to bypass environmental impact assessments entirely. Under the new framework, developers can self-declare compliance using online forms, without external verification. Alarmingly, the law would also strip federal authorities of oversight over large swathes of Indigenous and traditional territories that have yet to be formally titled.

Government Response: Mourning and Strategic Calculation

The government has responded with visible dismay. Environment Minister Marina Silva described the bill’s passage as a “day of mourning” and warned of its potential unconstitutionality and incompatibility with Brazil’s international environmental commitments. The administration is now weighing its options, including a possible veto or legal action.

However, the political arithmetic is not in Lula’s favour. The current conservative majority in Congress far exceeds the two-thirds threshold required to overturn a presidential veto, leaving the President with limited room to manoeuvre.

Lula’s Dilemma: Between Principle and Realpolitik

As stated before, Lula da Silva has until approximately 8 August (today) to act. He may veto the bill in full, approve it as is, or issue a partial veto to excise its most egregious clauses. According to sources close to the administration, a full veto, though symbolically powerful, is viewed as politically unfeasible. This is down to the fact that congress can override the decision.

However, a selective veto, targeting the most dangerous provisions, is considered the more realistic option.

Concurrently, the government is preparing to challenge the bill’s legality in court. Legal experts argue that several provisions may violate constitutional protections for Indigenous lands and environmental safeguards.

The Broader Implications

The passage of this legislation threatens to undermine Brazil’s credibility ahead of COP30, which the country is set to host. The timing is particularly precarious, as Lula’s administration has sought to restore Brazil’s image as a climate leader following the environmental degradation that marked the Bolsonaro era.

Environmental groups, civil society organisations, and international partners are applying mounting pressure on the President to act decisively. A failure to do so could irreparably damage Brazil’s global standing and derail its climate diplomacy ambitions.

Horrific doesn't even begin to cut it. A massacre is horrific, a natural disaster is horrific, a plane crash is horrific, this is more destructive than a mere outburst of violence or a storm or an unfortunate accident. It is not an unfortunate and temporary deviation from some norm, this is the wholesale destruction of an entire nation of people through bombings and starvation.

In December of 2023, just a couple of months after October 7th, they very candidly classified Israel's actions as genocidal.

The Lemkin Institute is one of the most authoritative independent agencies when it comes to the analysis and classification of what does or doesn't constitute a genocide.
