Fyi everyone. I received information back from Solaz that the options in the email they gave to us are all included, it is not a choice of options. They are giving us a transfer if our unit to Hacienda del Mar PLUS 50 percent off food and drink PLUS 7 nights at the Hacienda del Mar hotel to use however we like PLUS the waiver of our 2022 Solaz maintenance fee PLUS extension of our contract year for each year we cannot use it. So for this year, we are transferring over to Hacienda del Mar but we will also get a year added to our Solaz contract.

My granddaughter and her new husband were down at HDM on their honeymoon and talked to some locals who said six resorts closed right after the collapse in Florida, and SOLAZ was one of them. That plus the precipitous closing in the early morning hours suggests a significant safety concern on the owners part. All the jackhammering also suggests a rebuilding rather than simply finishing of uncompleted units. Though this is upsetting to us owners, it is certainly better than the alternative. Hopefully, as soon as they figure out what is needed for the fix they will give us some timeline on the repairs rather than leave us to speculate on the worst possible scenario.

Agree to terms or refund

We served papers to Solaz via Jose Moreno, a local attorney, to be sure to protect our ownership rights. Meanwhile, we are trying to find amenable terms of compensation to continue our ownership rather than getting a refund.

We have been given various pieces of information on Solaz. They are definitely going back in and fortifying the strength of the patio floors. I’ve been told that for units in the midrise buildings, which did not have patio hot tubs, they are fortifying those so they, too, will have the same comparable features as the lower units closer to the pools. We’ve also been told that they will build out the remaining units during this time so that there are more available units for the rental pool. Given that Cabo is still limited with 50% occupancy for an undetermined period, that would be helpful looking forward.

In the communications we have received directly from Solaz, they seem to believe they will be up and running sometime in 2022. I find that hard to believe, but we shall see. Given the location, style and amenities, it is hard for us to find a comparable replacement unit. We went down in July to see the property in person, talk to locals and also attempt to find a suitable replacement property. But we love being close to San José del Cabo and the modern, warm flair of Solaz. We would like to believe that someone will NOT let the Solaz project close down. But who is to say how long the repairs will take, what the ultimate cost will be and if a new owner, if there ever is one down the road, will honor any commitments made to those who decide to hold out and not ask for a refund. It is difficult to put faith in a company who has not been forthcoming and honest with its owners and supporters.

Hello! We own a 3-BR suite. Thanks for all the great info! Any further word if owners have a legitimate claim of default by Solaz and request cancelation or refund? Any word on method, process and deadline for owners to submit any claims / demands to Solaz? Has anyone been doing this and have the numbers been growing? Seems like the owners need to organize. Thanks!

If anyone has any further information or connections to the owners in the tower buildings, please let me know and/ or post here. We believe the owners may have more details than we were given as they have far more at stake than most. We hope this has been helpful to others who are interested in not losing their money.

Are there any PENTHOUSE/ single family unit owners out there reading this? Please let me know.

We walked the beach over to Solaz today. Surprisingly there was nothing blocked off from the beach side. We walked up to the patio on the side by the “penthouse” buildings (where each floor is a single unit and owned by a single owner rather than timeshare or hotel) I was surprised to see all of the chaises around the pool, each with a towel rolled up on it. This is the pool for the penthouse owners. We noticed a person in one of the middle units on the patio but by the time we got close enough to yell up, they were gone. We noticed a few places where the building appears to have been “opened up” on the first floor and top floor, in the same area above patio glass doors at the ceiling. It appears they are looking at something in the substructure of the building. We saw some type of wire rigging with winches attached to the same building on the non-window, non-patio side. We also had noticed people on the second to the top floor patios on the second building over the last two days. It appears the owners of these units may still be allowed in? Maybe they have more information as sole owners of those units, but it would be good to know. So if any penthouse unit owners are out there, everyone would love to hear from you.

We walked around the patios in front of the hotel, bars and toward La Deriva. All the patio furnishing are gone, anything else was covered up and the place was deserted. I saw a guard, perhaps, in the distance, but no one seemed in a hurry to rush over and ask us to leave. We took photos I will post shortly.

I have had some people tell me they have received offers to refund the money paid. We have not had that happen to us, but we filed legal papers, by a legit Mexican attorney, José Moreno (aka José Manuel Moreno Guzman) and a commercial notary. We met José in person after researching to be sure he was a legitimate attorney licensed in MX. I have copy of that license as well. After providing a copy of our contract, we paid $425 to have José draft up the filing. We signed all the papers as necessary by MX law. He accompanied the notary to serve the legal papers (there were multiple being served at the same time as José has been retained by many other Solaz owners at this time and has served papers on Thursday, Friday and Saturday on behalf of many owners.) We were provided photos and videos of the papers being served.

This is an email I received from Alan Thiers. It may help those of you interested in preserving their rights - whether you want to negotiate something other than what was offered to you or ask for a refund. Alan & José Moreno, the attorney, and one of a few commercial notaries, work as a team. José reviews the contract & draws up the legal papers to serve the ownership group/ developer, Alan make sure the team has all the necessary paperwork from the client and serves as the communicator since José is busy reading and writing serve the papers to Solaz. They bring in a third party, registered Mexican notary, which is the person to serve legal paperwork to necessary parties in Mexico. It is a bit different than in the US. Property owners and timeshare owners don’t have the same rights as in the US - it is all about the contract.

According to Alan, the price paid for one week at Solaz in 1-2 bdrm suites ranged from $18k to $150k. So depending on how much one invested and whether it was all paid off will probably determine how eager someone is to pursue negotiating an offer being what is being offered.

What I can tell you is that we’ve stopped at the gate at Solaz a few times now. We can hear the jackhammers and see people milling about. We’ve heard the stories of people being asked to leave at 3am, the couple who were there last to leave last Sunday and workers who were given notice and those who were not. We also do NOT see cranes or any signs whatsoever that they are doing anything to begging construction on the north set of three buildings. I believe that is a fallback excuse since we purchased 7 months prior to opening and were told all along that one day they would eventually build those buildings. Our contract, which appears to be the typical contract, does have a paragraph regarding contract default on behalf of the seller. Not being able to use our purchased period of time constitutes a default. There has not been enough information from Solaz, Quinta del Golfo de Cortez or Olarena to define the problems the buildings face nor a timeline. This could be a two year fix or a five year rebuild. No one knows at this point and I’m sure they haven’t uncovered the root of the issues to really know what they face.

Hacienda Del Mar is a dated property and now an equal substitute for Solaz. We owned there for 20 years and it has definitely seen better days. They are STILL selling timeshares for HdM. I guess the ownership could possibly go k bankrupt or maybe decide to walk away from the project if they find the structural issues more than they can afford. Who knows?

Someone posted the contact at HdM for Solaz is Ricardo Castillo. The gentleman we met who has been the manager - not GM - since opening in late 2018 is Ricardo Bonilla Castillo. His email is [email protected].

He has been given a small, young staff of 3 people to help with all the calls to owners. We asked him more than once to please be transparent with owners and offer as much info possible. He has not been given a ton of info but did confirm there are structural issues.

Hi there — Can you please provide info on the paperwork you submitted and what you’re submitting multiple of each day? Are you also sending something in the mail? Unfortunately this 5 day timeline is moving very so would like to do the same ASAP

Everything must be submitted in Spanish. It is being served by an official commercial notary who is accompanied by the attorney. They video and photograph the recipient accepting the papers.
