Well he was confident enough to tell her he'd quit bugging (fighting for) her if she didn't show up.

That’s not confidence. Neal is trying not the piss Emma off.

Neal already knows that “this is [his] second chance”. Since he thought that the danger was gone that everyone was safe and they could get back to their normal lives, he figured that if she STILL isn’t interested in reconciling then he’s not going to add stress and uncomfortableness to her life. If she wants to go on a date with him now, then great, if not then he’ll get out of her way. If she is ready later on, then he’ll let her come to him, rather than annoy her for forever when she’s not interested.

He is putting a bit of an ultimatum on her, but would you be happy if he continually pursued her for weeks/months when she’s not interested? He needs to leave the decision up to her at some point.
