Jeff Olson, the 40-year-old man who is being prosecuted for scrawling anti-megabank messages on sidewalks in water-soluble chalk last year now faces a 13-year jail sentence. A judge has barred his attorney from mentioning freedom of speech during trial.

A FREE SANTA Rally Begins 6:00pm TODAY (Dec 21) at Travis County Jail (500 W 10th) in Austin Texas!
According to Occupy Austin's Facebook page, Santa was arrested for writing Christmas wishes with sidewalk! Long time Arctic activist and advocate on behalf of world peace Kris Kringle, a.k.a. Santa Claus was arrested by Texas State Troopers today. Claus was chalking Christmas wishes for the world on the sidewalk near the Texas Capitol when Troopers tackled him to the ground in front of children and other holiday merry makers. A helpful elf, Corey, chalked 'Free Santa' and was also arrested. "DPS has overstepped all boundaries today and I will stand and wait for Santa, I hope he's out quick, I hear he still has a lot to do to get ready for Tuesday," said Chris Micheal a witness from Occupy Austin's Occupy Your Capitol working group. Occupy Austin stands in Solidarity with Santa Claus and is organizing a Free Santa Rally to bring jail support. If you want to help you can: -- Join the Free Santa rally at the Travis County Jail (500 W 10th St). Bring blankets, warm drinks, chalk, snacks, signs, Christmas decorations, and your friends! -- Call the Texas State Preservation Board (512-463-5495) and tell them that chalking is constitutionally protected free speech and demand they free Santa now! Many courts have upheld the right for activists to chalk, and state preservation board guidelines specifically state that they do not overrule the constitution! -- Call the Texas State Troopers ( HQ: 512-424-2000 Capitol Patrol: 512-463-3199 ) and tell them that chalk is free speech, not criminal mischief, and demand they free Santa now! -- Remember to be polite in your calls.

Passersby didn’t seem too concerned with the action, which was mostly quiet, consisting of people chalking, holding signs, and handing out flyers. Eventually, security guards from the French Market, the owner of the amphitheatre property, approached the group and ordered the protesters to remove the chalk and disperse, warning them that graffiti was a felony, and it was on private property (albeit for public use.) As all this was being announced, more French Market staff appeared with hoses and brooms and quickly washed away the chalkwork. Feeling somewhat defeated, but mostly astonished that sidewalk chalk would incur a felony charge, the protesters called it a day.
An occupier participates in a little-known action in Zuccotti Park in the wee hours of the morning, drawing the blueprints of the #OWS encampment in chalk:
"From this angle all I can see are his boots, more particularly the black military boot, buckled in silver that is blocking my ability to finish my chalk drawing. It is three in the morning and I am about to be arrested. I am using chalk to draw out the blueprints of where the tents had been prior to the dismantling of the Occupy Wall Street encampment by the NYPD in Zuccotti Park."
