No such thing as free publicity
I've noticed a couple of websites (dubtrack.fm and cloudmix.it) recently that are using the Soundcloud API to allow people to create playlists of tracks that are publicly available via the API. Kind of like a user powered online radio station... Which set me off thinking. Aren't online radio stations bound by similar laws to any other media that broadcasts music? Don't fees have to be paid to the appropriate agencies to ensure that the artists who are being played get the appropriate royalties? Their argument is that the tracks are publicly available in soundcloud so they have the right to use them, and that it's a great way of promoting your music. My argument is that I've never given permission for my music to be used in this way and as the owner of the copyright to my material, it is ME who decides where it is played. My soundcloud account is mainly or demo material which, whilst I'm happy for it to be public, is not release ready. Their surefire way of stopping them using MY music in this way is to disable app access for each track, but then surely this disables access to other apps which I specifically choose to use regularly. This may all be perfectly legal but it makes me a little uncomfortable! I'd love to hear what you think!
