Children, whose numbers have not been previously reported, are among tens of thousands of migrants returned to Mexico under a Trump administration policy known as the Migrant Protection Protocols (MPP). Most are from Guatemala, Honduras or El Salvador. According to the Department of Homeland Security (DHS), decisions about whether a person is placed in MPP are made by border agents on a case-by-case basis and include consultation with medical professionals. Unaccompanied minors should not be sent back to Mexico, according to the program guidelines, unless they are with their parents. About one third of the nearly 50,000 migrants in the MPP program as of Oct. 3 were children under 18, according to the latest data available from the Executive Office for Immigration Review (EOIR), which oversees U.S. immigration courts. Of those, Reuters found around 4,300 under 5 years old and 481 under 1 year old.

This week our President referred to undocumented immigrants as "animals", An NYC man harassed restaurant employees for speaking spanish and accusing them of being undocumented and being on welfare (and not a single news outlet included in their article that undocumented people DO NOT RECEIVE ANY SORT OF PUBLIC ASSISTANCE, allowing this virulent myth to prosper), The Attorney General just trampled over democracy and judicial independence by stripping Immigration Judges of their ability to administratively close cases on their docket - thus creating an even larger backlog of immigration court cases and forcing many immigrants with a right to LEGAL relief to take a deportation order instead.

Most Americans don't pay attention to immigration law, simply because we don't have to. The minutia of what comprises this nation's immigration laws are never talked about in the media. The topic of immigration law only comes up in political arguments, in which both sides of the debate are usually grossly misinformed. 

I don’t expect the masses to suddenly take an interest in what is going on within the Department of Justice and Department of Homeland Security - there are many other satisfying news stories out there that you will follow. Instead, I am just using this as an outlet to mourn the nation I once loved.

EOIR data release on asylum so deficient public should not rely on accuracy of court records

The following analysis was published on 3 June 2020 by the Transactional Records Access Clearinghouse (TRAC), a non-partisan, non-profit data center at the University of Syracuse.

TRAC has concluded that the data updated through April 2020 it has just received on asylum and other applications for relief to the Immigration Courts are too unreliable to be meaningful or to warrant publication. We are therefore discontinuing updating our popular Immigration Court Asylum Decisions app, and will take other steps to highlight this problem. We also wish to alert the public that any statistics EOIR has recently published on this topic may be equally suspect, as will be any future reports the agency publishes until these major data deficiencies are explained and rectified. The Trump Administration is gagging America’s immigration judges

For more than two years, immigration judges have been subject to a policy that more or less prevents them from performing an essential part of their civic duties: speaking publicly about their work.

Since September 2017, immigration judges and all other employees at the Justice Department’s Executive Office for Immigration Review have been required to adhere to an onerous pre-approval process whenever they desire or are invited to speak publicly on any issue, immigration-related or not. I learned of the policy through a Freedom of Information Act request my colleagues made to the department, as part of an investigation I’ve been conducting on the intersection of free speech and US border enforcement. Troubling new EOIR regulations

This piece was written by Jeffrey S. Chase, immigration lawyer in New York City, former Immigration Judge, senior legal advisor at the Board of Immigration Appeals, and volunteer staff attorney at Human Rights First. On July 2, the Department of Justice published final regulations impacting how decisions of immigration judges will be reviewed, both on appeal to the Board of Immigration Appeals and by certification to the Attorney General. I plan to cover the topic in depth in a later article, but I wanted to post my quick take on the fact that the new rule encourages the BIA to decide cases using two sentences of boilerplate language (plus a citation) that provides no insight into its determination process.
