The ERPO
Got to meet a district judge the other day. I was invited to a conference room in the sky as a local bar association member. The judge was there to talk about a new tool in Maryland, allowing judges and law enforcement to order surrender of guns, called the Extreme Risk Protective Order (”ERPO”). This emerged from Maryland’s recently passed “red flag law.”
The judge said in Baltimore, the issuance of these orders has lagged behind other districts. She opined that this was because Baltimore’s law enforcement is overworked and understaffed; reactive rather than proactive. My friend, the one who convinced me to go to this continental breakfast talk, asked the judge: “Don’t you think a family member who is concerned about extreme risks may be hesitant to petition for one of these orders, knowing that their family member could go to prison for an illegal weapon possession charge?”
“Not a question, this is an issue,” said the judge. “And many in Baltimore are familiar with mandatory minimums for illegal possession charges, so it is not surprising that, culturally, people would be hesitant to petition for an ERPO.”
It shouldn’t have been a surprise to learn that people in Baltimore don’t trust the police.
But here was the scary part:
The judge went on and commented on a type of petitioner who appears frequently: the mother concerned about her adult son living in the basement. He has isolated himself, he may have a psychiatric condition, he has a gun or guns, and he has made threats...
I’m glad to know there’s an ERPO for that guy.
