1. NO PURCHASE IS NECESSARY TO ENTER OR WIN.
2. Eligibility: Caption This:Contest! is open to all individuals over the age of 18 and who are a resident of the United States. Employees of Tedder Industries, LLC and its subsidiaries, and the immediate family of any such persons (spouse, parents, siblings and children and each of their spouses) and persons living in the households of each of these individuals whether related or not are ineligible to participate or win.
3. To enter: The Promotion begins on October 12th, and ends October 19th at 1:59 p.m. Pacific Time (the "Contest Period"). Sponsor's computer is the official time keeping device for this Promotion. To enter, you will be required to provide your email. All entries must be received by expiration of the Contest Period. We will contact the winner by sending them a personal message for their shippibng information. Entries become the property of Tedder Industries, LLC and will not be returned. Proof of submission does not constitute proof of receipt. By entering this Promotion, you agree to these Official Rules.
4. Limit: Each entrant must have his or her own email address. Multiple entrants may not share the same email address. Using multiple/different email addresses, identities, registrations, logins, or any other method to attempt to enter the Promotion more than the allowed number of times will void all of an entrant's entries and that entrant may be disqualified from participation in the Promotion. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. If there is a dispute as to any registration or play, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner(s) may be required to show proof of being the authorized account holder.
5. Winner: The winner will be randomly selected next Friday October 19th at 2:00 PM PST. The winner will be notified via direct message for his/her shipping information. If a potential winner cannot be reached within fourteen (14) days from the first notification attempt, then such person shall be disqualified and an alternative winner may be selected. Winner may be required to sign and return an Affidavit of Eligibility, Liability Release and, where lawful, Publicity Release, including Social Security Number or Taxpayer Identification Number for tax reporting, or the prize may be forfeited. All prizes are "AS IS," "AS AVAILABLE," and without warranty of any kind, express or implied, including without limitation any implied warranty of merchantability or fitness for a particular purpose. All federal, state and local taxes and duties are the winner’s responsibility. A prize may not be transferred, substituted or redeemed for cash, except that Tedder Industries, LLC may substitute a prize of equal or greater value.
6. Decisions: By entering into the Promotion, entrants agree to abide by and be bound by these official rules, and to accept the decisions of Tedder Industries, LLC as final. Except where prohibited by law, entrants agree to release and hold Tedder Industries, LLC, its FFL holder designee and each of their officers, directors, employees, members and representatives, and agents harmless from any liability arising from participation in this Promotion and/or the acceptance of the prize. Tedder Industries, LLC is not responsible for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries, whether due to system errors or failures, faulty transmission or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, spam filters, or otherwise. Tedder Industries, LLC may prohibit an entrant from participating in the Promotion or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Tedder Industries, LLC. If for any reason this Promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Tedder Industries, LLC which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Tedder Industries, LLC reverses the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and randomly draw from those entries received up to the cancellation/suspension date. Tedder Industries, LLC reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who fails to follow these official rules or who is ineligible or has violated any rule, gained unfair advantage in participating in the Promotion, obtained winner status using fraudulent means or made any misrepresentations relative to the Promotion and prize redemption.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, TEDDER INDUSTRIES LLC RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
By participating, entrants acknowledge and represent that they unconditionally agree to be bound by these Official Rules and the decisions of TEDDER INDUSTRIES, LLC, which are binding and final in all matters relating to this Promotion and waive any right to claim ambiguity in the Promotion or these Official Rules.
7. Publicity: Each winner agrees to permit Tedder Industries, LLC to use his/her name and likeness in promotional and other Tedder Industries, LLC materials, without additional compensation or permission, except where prohibited by law. Each winner also agrees that their name and prize amount will be given to other entrants upon request.
8. Compliance with Law: All issues and questions concerning the construction, validity interpretation, and enforceability of these official rules, or the rights and obligations of the entrant and Tedder Industries, LLC in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Idaho, without regard to its choice of law provisions.
9. Resolution of Disputes: Except where prohibited by law, as a condition of participating in the Promotion, each entrant agrees that (1) any and all disputes and causes of action arising out of or connected with the Promotion drawing or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest Coeur d'Alene, Idaho; (2) the laws of the State of Idaho will govern the enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will any participant be permitted to obtain awards for, and each participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than actual out-of-pocket expenses (i.e., costs associated with entering the Promotion), and waives all rights to have damages multiplied or increased under any federal or state law.
10. Miscellaneous: This Promotion is void where prohibited. Tedder Industries, LLC may substitute prizes of equivalent value, amend the rules or discontinue the Promotion at any time. Tedder Industries, LLC disclaims any responsibility to notify participants of any aspect related to the conduct of this Promotion. The name of the winner and written copies of these rules are available by mail upon written request to Tedder Industries, LLC, 4301 W. Riverbend Ave, with a stamped, self-addressed return envelope. All captions must be received by October 19th by 1:59 PM PST.
