I was tagged in a post I had not yet seen of Elijah McClain's injuries. I reached out to his mother to get permission to repost them. I dont see how these injuries come from "the story" the police gave smh. It breaks my heart every time I think about my children his shoes. The man who ran over and killed Aboriginal teenager Elijah Doughty in Kalgoorlie last August could walk free from jail in seven months.

He was never charged with murder and was cleared of manslaughter by a Supreme Court jury, which convicted him of the lesser charge of dangerous driving causing death. He was given a three year jail term but  could be released on parole by February.

There have been nationwide protests in response.

Justice for Elijah

Correct me if you think I'm wrong. I ain't Aboriginal or Torres Strait Islander, but I'm just trying to sift through my thoughts on Elijah's tragic case. I'm not pretending they're worth much.

Was the judge and/or jury racist? I dunno. But I do know none of them were Aboriginal and a lot of research shows what a difference the racial make-up of the court makes in cases this drenched in racial tension. And a principle of the courts is that justice must not only be done, but be seen to be done - an all non-Aboriginal judge and jury in such a case doesn't look like that to me. The court sorta failed its own brief.

Was the driver racist? I dunno. But I can't help but wonder if he would have driven a big car so dangerously close to a kid if he didn't devalue that kid's life (if he wasn't, in fact, attempting to hurt or kill him). Maybe he just devalued the life of suspected child thieves. Or maybe he devalued the life of Black kids. It would kinda be a miracle, growing up in this country, in that town, not to. Black kids being chased by white guys in cars was a common occurrence in this town. It seems a bit Pollyanna to say the racial element here is just coincidence.

Was there enough evidence to demonstrate beyond reasonable doubt that this was manslaughter? I dunno. Reasonable doubt IS hard to prove. But the fact that police destroyed what coulda been vital evidence when they drove over the tracks leading to the crime scene makes me wonder if it coulda been more likely with that evidence in tact.

Is my perspective on this case limited? Yep. I'm not Aboriginal or Torres Strait Islander. That doesn't mean someone who is is automatically an infallible genius - but it does mean I probably don't have as sharply honed a racism detector cause my lived experience hasn't required me to hone one. It also means I don't have skin in this game. This court decision doesn't tell me something about how my kid is valued. Also, I wasn't in that courtroom, don't know the people involved and am going off media reports that themselves could be warped.

Are people "entitled" to be outraged by this decision? Yes (though people don't need my "permission" to be outraged, who the hell am I?). There are way too many cases of Black kids and adults being race-based crime victims, let down/outright targeted by fellow citizens, the police and the courts. There's a pattern. And there's more than enough to point to here to suggest this case fits this pattern. And noone would be paying attention to this case if there weren't protests. And it is vital we pay attention to this case. Because this pattern needs to stop. A lot of systematic work needs to be done in this town, in police stations, in courts, in this country.

I sorta didn't want to write this out cause maybe I'm speaking outta school. I ain't Aboriginal or Torres Strait Islander and have no special connection or inside scoop on this case. But I think it's important to look closely at this case and try and understand it. Because this tragedy was avoidable. And the cops and court's handling of it was ... questionable. Maybe I'm being too kind, or not kind enough. Your call.
