Based on the feedback from some prospects and investors, some of them don't understand property title and some don't even bother to know while some are overwhelmed with my articles. *LAND TITLE DISCUSSION CONTINUE*❤❤ THE CERTIFICATE OF OCCUPANCY (C of O) The rush for a certificate of occupancy land or property today has reached an alarming proportion. Nowadays, people want c of o land by all means but has less budget to do so. Some even believe and erroneously assume that if a property does not have this title it's not genuine at all. This is incorrect. C of o was very popular then because investors use it to obtain loans from the Bank. But now all land titles are valid in the eyes of law. Some investors prefer Government Excision to c of o because it doesn't expire and it's freehold. What is a Certificate of Occupancy It's a legal land document issued by the State government (Governor) stating that it officially leases, for example, Lagos LAND to you, the applicant, for 99 yrs? It's the right of the government to do so because all LAND belongs to the GOVERNMENT. C of O is almost the same as the right of occupancy (R of O). The latter is usually granted by a Local Government Authority as defined as a customary right of occupancy. The definition is in Section 6 of the land use Act, a customary right of occupancy includes the right of a person or community lawfully using or occupying land by customary law for agricultural, residential or for other purposes. In some other states including FCT Right of Occupancy is always used instead of C of O As already indicated above, all lands belong to the government. A-C of O is the officially recognized document for demonstrating the right to land. The C of O is renewable when it has expired. Note that the duration depends on the State you're dealing with. In some states in Nigeria, it is not up to 99 years before it expires. C of O is C of O everywhere. When they said Global it means the C of O in question is issued to a community and it covers a very large expanse of land. In this picture was a Heritage Manor estate launched yesterday at Ibeju Lekki just opposite P.A.U that has EXCISION Excision as the name implied is not a land Title in real estate transactions. It's a status on the land stating that the government is not interested in it and has no business whatsoever to do with the said land even in near future. HISTORICAL PERSPECTIVE The excision came into being as a result of the Nigeria LAND USE ACT 1978 that recognizes ancestral ownership of land but it's also said that it is the right of the government to regulate how excision is been granted to the village applying for excision. In this case, the government of the day recognized the indigene have a right to existence, a right to the land of their birth and by default is expected to cede a portion of land to them. When this happens it is left to the natives to do whatever they wish with the portion that has been given to them either by building on it or sell to commercial real estate developers. THE LITERAL MEANING OF EXCISION Excision means the process of taking apart from a whole that and that part has been EXCISED will be recorded and documented in the official government records notebook of the State known as GAZETTE. In this case, one can bring it down to a layman understanding that EXCISION is the process whereby the government of the State, for example, Lagos State, cut some parts of the State LAND and give to the ancestral community. In a nutshell, as somebody who wants to buy or acquire property (land) when you see EXCISION on flyers anywhere, don't be scared. This means that the LAND is no longer in government control again and thereby FREE from any form of ACQUISITION whether government or individual. How long does it usually take on average for a land to be fully excised? Excision is given by the governor of the state and there is no specific time for issuance of Excision. Sometimes excision can be delay due to political reasons.
