Just vs. Unjust Refutations

Whoever is known with always intending with his refutations, sincerity towards Allah and His Messenger (ie: sincere advice), it is compulsory that he is honoured and respected and regarded just like the various Islāmic scholars that we have mentioned previously and their likes and those who followed them with goodness. ومن عُرف منه أنه أراد بردِّه على العلماء النصيحة لله ورسوله فإنه يجب أن يُعامَل بالإكرام والاحترام والتعظيم كسائر أئمة المسلمين الذين سبق ذكرهم وأمثالهم ومن تبعهم بإحسان. But as for the one about which we know that he intended to belittle them, vilify them and expose their faults! This kind of individual will be dealt with with (sharīʿah compliant) punishments that will deter him and his likes from these lowly traits (i. e backbiting, slandering and so on). ومن عرف منه أنه أراد برده عليهم التنقص والذم وإظهار العيب فإنه يستحق أن يقابل بالعقوبة ليرتدع هو ونظراؤه عن هذه الرذائل المحرمة. These intentions are known at times via the confession of the refuter or via him admitting it. ويُعرف هذا القصد تارة بإقرار الرادِّ واعترافه، At times, it might be known through the circumstances surrounding his action and words. وتارة بقرائن تحيط بفعله وقوله، So, whoever is known with religiosity and respecting and honouring the muslim scholars, such will not speak about refutations and explaining of errors except in the manners which the great Imāms of Sunnah saw it. فمن عُرف منه العلم والدين وتوقير أئمة المسلمين واحترامهم لم يَذكر الردَّ وتبيين الخطأ إلا على الوجه الذي يراه غيره من أئمة العلماء.
