Debra Milke was the first woman to be sentenced to death in Arizona since 1932, and the second woman of all time to be exonerated from death row. Milke was accused of murdering her son, Christopher Milke, in 1989. Christopher had first been reported missing by Milke’s roommate, Jim Styers, who claimed that the boy had gone missing during a trip to the mall. Phoenix police later arrested a good friend of Styers’, Roger Scott, who led police to the body after over half a day of questioning. The young child had been shot in the head 3 times. Scott then confessed to police that Styers had been the one to kill Christopher, and that he was doing so under Milke’s instruction. However, in spite of his claim, Scott would not testify to this in court.
Milke voluntarily went to the local Sherriff’s office, where she was interviewed by a single officer, Detective Saldate, who later provided a written report stating that Milke had confessed to arranging the murder, although there were no other witnesses or recorded evidence to back up this claim. During the trial, prosecutors focused heavily the so-called confession, as well as the fact that Milke had recently taken out a $5000 life insurance policy on her son. However, Milke worked at an insurance company, and had received this policy as an employee benefit. In 1990, Milke, Styers and Scott were all convicted and sentenced to death.
Eventually, in 2013, Milke’s conviction was overturned after Saldate’s personnel file was never handed over to the defence, which included eight cases where confessions were thrown out due to Saldate lying under oath or violating the suspect’s rights, as well as multiple other instances of misconduct. The charges against Milke, who spent over 2 decades on death row, were formally dismissed in 2015.
