Sunday night about 10 minutes to 10 o'clock, a window was broken in the borne of Nick Lubjck, at 354 Rideau Street. It was alleged that Nick Zelinsky, living at 598 Montreal Street, smashed the window with a club. The accused denied the charge and as there was no evidence to substantiate the charge it was dismissed by the magistrate with costs.
Lubjck told the magistrate about the window bring broken but he had no evidence to offer as to the party or parties who smashed the window.
“I was in a room upstairs and heard the crashing of glass in the window,” said a witness called for the prosecution. "I ran to the window in my room and looked out and I saw a man running away. He was about one hundred feet away at that time I do not know who he was."
Another witness called for the prosecution stated that he heard the window crash but he could not identify the party who was responsible.
The accused was called to the witness stand.
"Who broke the window?” the magistrate asked.
"I do not know," was the reply.
"Were, you near this house between 9 and 10 o'clock on Sunday night?”
“No I was not there. I was at a party."
The plaintiff then asked the accused if he had broken the window and again the accused denied the charge.
"I will dismiss the case with costs,” said the magistrate.
