Depending on how similar they are...the recreations of emojis can technically be considered copyright infringement, thus making it illegal.
This is not to say I'm pro-endo I'm just a design student and copyright law is something I know very very well. It is true that no art is truly original but there are cases where things are clearly stolen. And that's an issue. I think it'd be better if emojis were created with different metaphors being used than the ones ripped (unless that already happened and I'm just dumb).
Most of the art wasn't recreations. They were completely new. They used a general style, but the heads of the emojis were different as were the colors. (For example, the anti-endo's sysmoji used a head that looks like a half Sun, while the other used a microphone head.)
The bodies were drawn different. The coloring was different. The objectheads were different. They only drew inspiration from the general idea rather than copying any specific elements.

I'll also add that all art is inherently derivative. People are constantly drawing inspiration from others. That first user didn't invent the idea of object head characters. They didn't invent the idea of system emojis. They took an idea that other people made and made their own thing.
