Non-American here so forgive my ignorance. You said a few times Trump has an advantage in the Supreme Court of 5-4. Why is that so? How can you tell already who will support him when the case has not been before the Supreme Court yet?
You're alright! I'm sure many Americans also don't understand what others mean when we say there is an advantage of 5-4 in the SCOTUS.
The numbers refer to the bias of the judges and how they're likely to vote. It has varied over the years as it depends on the judges currently on the court. In this court today, it holds a bias towards conservative values, or at least a stricter interpretation of the constitution. 5 of them have shown to value the constitution greatly, having already voted down a New York lockdown as it violated religious freedom.
Earlier, when ACB was in the process of being confirmed, we had assumed this Court was going to be a 6-3 conservative biased Court, but Chief Justice Roberts has shown he is now either a wild card or his views has shifted to that of a liberal judge, as he voted the New York lockdown towards religion was constitutional.
It's also worth noting that Biden & Harris hasn't made any favors towards the majority bias in the Court, laws aside. 3 of which were harassed by them during their process of being confirmed on the Court. But, all are now invested in this in another way as Biden has danced around answering if he'll pack the SCOTUS. At one point, he openly told potential voters they "don't deserve to know" if he will pack the Court or not.
For those unaware, packing the court refers to a president adding as many Justices as it takes to make a desired viewpoint hold a majority bias in Court. If Biden does this, these Justices will lose their voice in the Court. As of right now, there are no limits on Justices in the SCOTUS, but the modern standard is 9 Justices and all modern presidents have respected this.
