Navigating Employment with Autism
Finding and maintaining a job can be a daunting task for many autistic individuals. What challenges have you faced in the workplace? Do you have any tips for job interviews or workplace accommodations?
Let's talk about disability rights at work.
Under California law (FEHA), if you have a disability, your employer has to actually TALK to you about accommodations—not just say no and move on. This is called the "interactive process" and it's legally required.
What does this mean? Your employer has to: • Listen to your accommodation request • Ask questions to understand your needs • Explore different options with you • Make a genuine effort to find solutions
And here's the important part: Courts have said that refusing to engage in this process is ITSELF illegal, even if the employer later claims "we couldn't have accommodated you anyway."
California courts (shout-out to the Wysinger and Gelfo cases) have been really clear that employers can't skip this step. If they don't engage in good faith, they can be held liable.
Most accommodations cost little or nothing—flexible schedules, remote work options, ergonomic equipment. Employers can only say no if there's "undue hardship," which means significant difficulty or expense based on their specific situation.
Know your rights. Document everything. And if your employer refuses to work with you? That's when you talk to an employment lawyer.

The Pregnant Workers Fairness Act (PWFA) ensures workplace accommodations for pregnancy, childbirth, and related conditions. Effective June 27, 2023, with final EEOC rules starting June 18, 2024:
✅ Reasonable accommodations (e.g., breaks, remote work, modified duties) ✅ Prohibits discrimination and mandatory leave if accommodations are possible ✅ Applies to employers with 15+ employees
