Things you can watch/do instead of YouTube, For those who may have trouble finding things to do.

1. Internet Archive. Has plenty of videos to watch, plenty of games you can play that are emulated right on the website. You can also find entire collections of roms. For emulators, check out Emulation General Wiki to find the best emulator for the system you want to emulate.

2. r/piracy has a wiki full of safe places to read comics and manga, to watch anime and cartoons, and to watch movies.

3. Virtualbox, you can set up a Windows XP virtual box and get old PC games from Internet Archive. You can also check out CD Game World if you need a no-cd patch.

4. Saltybet. A Livestream of MUGEN with thousands of characters fighting against each other, sometimes things get hilarious. Runs 24/7.

5. The Cutting Room Floor, spend hours reading up on cut content from your favorite games.

6. Lost Media Wiki, read up on lost movie, books, animation, video games, etc.

I'm reading thru the UHC post right now and honestly I dont trust Gio one bit, this is not at all reading how I think he wanted it to read.

Literally this is reading like he went in with extreme hostility and distrust of Hussie which he tried (and failed) to hide, and they acted accordingly with a bad actor. I mean for fucks sake you keep he-him-ing Hussie (who uses all pronouns), which is a much bigger red flag to me than anything Hussie's done

At every turn in this, Gio is painting everything Hussie and the Homestuck Folks do in as negative a light as possible, and then going "Ah geez but im just a victim, theyre trying to push me out for NO REASON other than they hate meeeeee", which is. Utterly ridiculous, you are ACTIVELY bringing up your distrust of them from the start, even saying you think *MERELY SPEAKING WITH* Hussie is a quote "terrible idea", like you CLEARLY dont want this to resolve into anything amicable here! And then you accuse THEM of blocking you out when the first person to express discontent was YOU, this is ABSURD

Also, as someone who has actually been trained in specifically copyright law as it applies to collaborative webcomic projects in my bachelors degree, nothing I am seeing from the legal side of this raises any real alarms. Contracts which refer to other contracts is extremely normal, and if theres anything in the referred contract which would present a problem, you can negotiate it WHEN YOU GET TO THAT CONTRACT, the line Gio refers to as "agreeing to a contract you cant see" is LITERALLY just saying that "when the time comes that you aign this license agreement you'll be beholden to it for these discussions" which is. JUST NORMAL SHIT!!!!

It is 100% by the grace of Hussie that you are allowed to operate AT ALL, and any lawyers who are tasked with defending the copyright probably think this is all a massive fool's errand to be not just allowing its existence FOR YEARS but also trying to reach out and work with you!!!! Your project is functionally no different in legal terms from abject piracy, you have ZERO legal standing to maintain the asset library, you even ADMIT THIS YOURSELF, christ

I will say I think to some degree Hussie IS being a bit more legally assertive than is perhaps conducive to collaborative projects, but honestly I think it's warranted considering how the Hiveswap Kickstarter money got functionally stolen by a bad actor abusing a flimsy contract with a younger Hussie, as well as the copyright limbo that the poorly-made Viz contract pulled them into. It is here that I must admit I have knowledge not just of Viz media's practices in general but also the very liaison that Viz had meeting with Hussie for that entire agreement (Long story, my Sister worked with them) and yeah they kinda pulled some shit on Hussie.

throw in that every single step of the way Hussie has been painted in a terrible light by a chunk of the fandom, and in particular by YOU Gio, and I think strong legal background is completely and utterly justified.

Gio proves continuously through this post that he is an armchair lawyer at best. At the point I'm at he's conflating a C+D with a Lawsuit--These are two very different things. A C+D is literally just a warning, its saying "Hey legally we CAN sue you, but we're gonna give you a message to say take it down first". I believe its actually required by copyright law to do this as an initial step, but its really just a warning. If one takes the thing down, then its over, no lawsuit goes ahead. After this, you have a DMCA takedown, which is where the lawyers call up to have it taken down from hosting, but is again, STILL NOT A LAWSUIT. A lawsuit is where you are served papers saying "Hey, we are suing you".

This is an important note here because Gio is continually treating the C+D like it can somehow financially harm him, when in fact its literally a warning. When "Lawsuit" is actually brought up, it is initially brought up by Gio, not by Miles.

The language in the HICU NDA *is* abnormal for such a contract, but again, I find it understandable considering Hussie's history with contracts being abused by bad actors. Like, I am not remotely saying that Hussie DOESNT have a tendency these days to be a bit controlling, I am saying that this is a justifiable coping mechanism given the past at play here!!

Miles finally confronts Gio for the fact that he was involved in the bullshit drama regarding Hiveswap/Homestuck based almost entirely on rumors. Asks for a public statement resolving this, and. Gio immediately treats this as an attack! As usual.

Gio acts as though this is an act of supplication, but this is really just undoing the damage done to the brand. Which IS substantial, I find it actually kinda hard to find folks who DONT distrust the leadership of Homestuck even today! An apology would go a long way toward fixing the brand.

This ALL, every BIT OF IT, comes down to Giovani hating these people, many of whom are transfem. In this section he refers to Hussie as a "Man" multiple times, even COMPARING THEM TO TRUMP, and again begins harassing Kate AGAIN. Yes it is all work that was available for free, but it was made under Hussie's control, on Hussie's website, with ads which compensated Hussie for the MASSIVE hosting costs!!!! To take that control AND financial compensation away from Hussie ABSOLUTELY PUTS YOU IN A "THIS IS ILLEGAL" SPACE! Add in that the UHC has a music player which includes music which was released *for purchase* you are ABSOLUTELY breaking the law

To put forward a more apt comparison: Lets say a musician posts a song, free to listen to, on their website. Theres some ad revenue from the website itself. What would constitute a "fan work" based on this would be if you decided to do a cover of this song, or sampled it in your own song, or something like that. Instead, what you have done is, the moment that the hosting on the original website fell apart, you decided to create a download for it on another website, with no ads and no connection to the original creator. And also created a media player which is attached, okay the metaphor kinda falls apart here but you get the idea.

The point is, YES HUSSIE DOES IN FACT HAVE LEGAL RIGHTS TO SAY "STOP USING THE ASSET LIBRARY WHICH YOU RIPPED FROM THE WEBSITE".

I feel like I should clarify here, because I dont want to come across as someone who thinks copyright law is all good and dandy and that piracy is some big great evil that needs to be snuffed out: I take a nuanced stance on piracy, wherein the matter of archiving work is very important, but that one should try to financially support indie creators where they can because Its Really Fucking Hard To Be An Indie Creative, and that taking down random artists' lifelines is not praxis, its just being a selfish asshole.

As this applies to Homestuck: Hussie IS, for all the fame of Homestuck, still an indie creator! She did not get massive funding from a huge publishing company for its original creation, they did not have a huge institutional support network for its original creation, she WAS for all intents and purposes just a single person with a website and a deaire to make a story! Homestuck WAS wildly popular, but even with that popularity estimates of the actual profit for Hussie have been well within the range of "highly successful indie creator". As such, it is reasonable to create an archive, but if the original creator is coming to you saying "Hey please give me back control of my creation which I still have legal control over. I'm willing to work with you if you though to make this project continue in some capacity" thats fully, 100%, within Hussie's rights, and actually kinda extremely generous of them to do so!
