This is one of those stories you couldn't make up if you tried. Most people, especially content creators, such as those with YouTube followings of 60K+ people know that much of the Internet is copyrighted. That just because an image appears in a Google Images search result does not mean that it's free to use. It's just plain common sense. At least, one would think so. But YouTuber and Internet 'entrepreneur' (that word is so overused these days), Dan Dasilva had to learn this the hard way. a friend of mine linked to this on facebook and all I can say is I’ve only ever seen one person online who felt more entitled to use other people’s images. this guy’s “defence” can literally be paraphrased as “some people maliciously copyright their images and upload them so they can make a living suing people for using them without permission.”

❗❗ Hey, please DO NOT buy from Milkybread’s online store. (twitter: @milkybreads_ , tumblr: milkybreads ) Their most recent product is a set of haikyuu acrylic stands, and the Bokuto one in particular was blatantly traced from another artist’s work. Most of their drawings were in fact traced from works of other artists, including oldxian, gusari, etc… They have been copying for over a year and the line was crossed when they started MAKING PROFIT from something that was TRACED. When someone direct messages them to stop copying, they brush it off with excuses that their style is just “ mixes of other artists [they] adore too…” Clearly their drawings are traced and they don’t even remove them. It is really upsetting to see someone with over 4k+ followers on twitter and tumblr get away with tracing art.
despite the fact she’s still trying to defame people who call out her blatant plagiarizing by claiming they’re plagiarists themselves, trying to make them out to be hypocrites, claiming they’re talentless artists who are jealous of artists like her, claiming they’re sockpuppet accounts of mine (even after given photographic proof they’re not), attempting to blackmail them into complying with her demands, or even going so far with me as threatening to have someone rape me and doxxing me more than once, Erzascarlet8 proves she’s still just a talentless hack who needs to leech off actual artists to share anything of quality.
not only has she blatantly traced from the Fairy Tail manga, she’s stolen from Getty Images as well this time. and it looks like rather than finding a way to rip it from the website without paying she just used a camera to take a screener vid of it. on top of that, she has the gall to present it as something she owns the rights to, as only the copyright holder has the legal right to list their work as being under a Creative Commons license.

that's actually not true. some of the legalese is confusing, but all you're giving them the rights to use royalty free are for things like sharing on other sites via the share buttons they generate for your uploads and things like using your artwork in banners advertising the site to give examples of content and also just simply hosting your artwork. the claim you give them the right to do what you say has been debunked more than once. I know there are two examples used to try and prove that what you claim is true, but those have reasons that are nowhere near that nefarious. the Adventure Time shirt that parodied an iconic scene from Totoro was originally done to be used on a cover of an official Adventure Time comic. the artists didn't look at the contract closely enough to see they'd also given them the right to use it on other merchandise as well. the use was justified not by the fact it was uploaded to dA, but by the fact the artist signed a contract with the creators of Adventure Time that allowed them to offer that art on officially licensed merchandise. the Homestuck shirt also had nothing to do with the artwork on it being uploaded to dA. it was artwork submitted to a contest and Hot Topic was one of the judges. they had the right, mentioned in the contest announcement, to make their pick of art to be offered on Hot Topic merchandise and that was the artwork selected for that honor.
The DeviantArt post is misinformation. It wasn’t dA’s fault. Sorry for that. I had to look more into it. I’ve seen that post floating around for a while and wanted to get to the bottom of it. It’s ok to post on dA but third party companies might steal your stuff, being Hot Topic. There wasn’t much the artist could do since it was characters from Cartoon Network and not her own.
the two biggest incidents used to prove Hot Topic steals content from dA are the Adventure Time Totoro parody and the Homestuck shirt they offered. both incidents involved no stealing and were done completely legally.
the Adventure Time incident gained a lot of notice because the artist in that case had that piece used as cover art on an edition of an Adventure Time comic. they didn’t read the contract clauses and assumed they were only licensing it to be used on that comic cover. however, the fine print granted them permission to use it on other merchandise as well. once they realized it they admitted they goofed and didn’t read the fine print well enough.
Hot Topic was also only selling it. it was officially licensed Adventure Time merchandise, not made by Hot Topic.
the Homestuck one involved an official contest where Hot Topic was on the judges panel and one of their selected winners would get their art featured on a t-shirt to be sold in Hot Topic stores. the contest was fully kosher and no theft was involved there either.
in both cases if it was actual theft they could have sued because it’s their original composition fanart, which counts as a transformative work. those are protected by copyright law. if Hot Topic had stolen them they wouldn’t have had permission from the original creators either, which would open them up to a lawsuit from them as well.

Okay, so, I see a lot of problems with people getting works stolen off the internet because the art is in a “public space.” While yes, that is true, the internet is public space and art is posted there, but that doesn’t make it public property, properly known as “Public Domain.”
Public Domain:
“Art becomes public domain only after 70 years after the artist who made the work has DIED, 95 years after publication, or 120 years after creation, which ever comes first”. (Source). This is why you are allowed to use famous works like Van Gogh’s “Starry Knight” or Da Vinci’s “Mona Lisa” freely with out copyright issues, the artist have died well over 70 years ago, thus the work they have produced is now free for the pubic to use.
Publishing:
Posting art on the internet is not considered published works. “Published works are works that are made into copies able to distribute to the public.” (Source). Posting art on a site like tumblr, deviantart, message boards, youtube, vimeo, or any other number of websites are meant for display, not for redistribution unless the artist as stated that: “This work is available for redistribution.” However, if you do not see that sentence anywhere, then that art is purely for display only and you must ask that artist permission to use that work unless you are favoriting it on deviantart, reblogging/liking on tumblr/blogspot, adding the video/song to a playlist on youtube, etc.
Intellectual Property:
Now, until the art work is under public domain, the works in question are protected under “Intellectual Property.” Where artist, inventors, writers, creators in general, are protected under the constitution and have full ownership of the works they have created from the moment it is created. (Source). Taking someone’s work that does not belong to you is considered theft and punishable by the full extent of the law. Meaning, the case can be taken to court and serious repercussions will ensue for the offender. (Source). The works are not just protected in the US, but world wide, and outlined in “article 27 of the Universal Declaration of Human Rights.” (Source).
Article 27.
(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits. (2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author. (Source).
TL;DR: Yes the internet is public space, but that does not mean the works on the internet is considered public domain. All works are protected by Intellectual Property until it has been 70 years after artist’s death, 95 years after publication, or 120 years after date of creation; whatever comes first. Posting works on the internet does not count as publishing.
It is safe to say, any works created now will not be free to use publicly in your lifetime unless stated otherwise by the creator them self.

Art reposting is wrong, but BULLYING is worst.
The results of these huge posts on tumblr asking people to report others is hate. People go and hate/do bullying on these people. Bullying shouldn’t be tolerated, is against human rights. Art can be deleted, but acts of hate such as “being called bitch” affect someone psychologically.
Sasusaku’s admin on instagram suffers from anxiety. I get you want to deffend your art, but be a human being and try to think there’s someone behind your screen. A person with daily life problems like yours.
She’s been called bitch, thief, only there for the followers, unsensitive within others names. People with anxiety do not react to these situations quite okay, they have panic attacks and sometimes these words and name calling keep them awake for nights.

loss of income can be a BIG deal for an artist, especially if they make part of their income from things like selling prints or doing commissions. loss of income can be a big enough deal to cause stress and anxiety, and finding out that someone is doing something that can make them lose opportunities to make money they need to get by financially can cause multiple kinds of mental health issues. loss of income is NOT a minor thing. heck, legally speaking when it comes to claims of fair use one of the major things that can make something not fair use is that use causing a negative impact on the income of the copyright holder.
and quite frankly, you keep going on that reposters are humans and have feelings, but you completely disregard the fact the artists are the same. they don’t like their hard work being disrespected, they can have issues with anxiety, depression, and so on too, they could be relying on their art as a way to supplement their income because they NEED that extra money.
the fact of the matter is, if your friend hadn’t disregarded the hard work the artists put in to their art AND copyright laws none of this would have ever happened to them. negative acts lead to more negative acts, and reposting without permission and credit IS a negative act. and if your friend is old enough to be going to college soon they’re old enough to know that too. your friend gets the blame for starting this, because they did something that is technically illegal that could have easily emotionally and financially hurt the artists whose work they reposted without permission. it doesn’t excuse the bullying they’re getting, but if they hadn’t done it in the first place or removed everything reposted without permission the first time they got called out on it then it wouldn’t have gotten this bad.
Question: I am making a mock magazine for school, and I’m using several pieces of art that I have found online for mine (its mermaid themed so its all drawn pictures of mermaids). Although my teacher said that we don’t have to ask for permission to use it in our assignment seeing that no one is making money off of it, I want to use mine in my portfolio to demonstrate my ability to create magazine spreads.
Do I have to ask the artist for permission for that? I’m not passing the image off as my own and I already have sources for everything within my spread, I just need to know if I need permission to use it as an example.
use in schoolwork can count as fair use. however, if you want to use it in your portfolio you're better off only using images you have permission to use.

i’ve discovered this morning that my own art, that i’ve posted on this blog, has been snatched and traced over (to colour and line by this person who has claimed it as their own, and to also get rid of my signature), and i am DAMN sure that the other pictures in their gallery are ALSO STOLEN !! they range from gravity falls to dragon age and now, my fanart doodle i did of chibi preston garvey from fallout 4, pictured below

i implore you that you look through their gallery and find if they’ve stolen any of your art as well. i would have been just fine if they asked to line and colour my art so long as they gave me credit, but seeing as they did not do that, they’re a tracer and an art thief. if you have a dA, report them.

I’d like to take a moment here to make a personal post, since it relates to one of the art thieves I’ve reblogged about here.
ErzaScarlet8, otherwise known as Erza Farron, Sasuke Scarlet, and a bunch of other names, has proven recently just how despicable a person they are.
beyond the art theft, beyond the harassment, beyond falsifying proof I myself was editing other people’s art, beyond doxxing me and acting like it was deserved because of a screenshot I shared which had her IP on it that showed how frequently she was checking out my main tumblr after she threatened me to remove my statcounter “or else”... she has gone even more low.
she used her kagemadara sockpuppet to post a screenshot trying to make me think she was contacting people who really knew me who were agreeing with her that I was a terrible person. in the screenshot it showed her listing several things she claimed I posted in falsehood. beyond things she’s done before like accusing me of using my niece’s name to make money off of people (she still apparently thinks that kickstarter for my niece’s comic to get a professional printing that Underbelly Comics did was me scamming people, even with the first volume of the comic being up for sale in digital form and the first batch of the print version almost being ready) she listed the fact I’ve mentioned my mom has passed away, implying I was lying about my mom’s death.
but that is not the worst part...
I made a comment on my main tumblr where I basically said “lol at her implying I was lying about my mom’s death.”
she proceeded to quote the “I was lying about my mom’s death.” part at the end out of context to her friends in a Google+ group owned by one Erin Anthony/PrincessElizabeth013 to make them believe I was someone disreputable enough to lie about the death of a parent to get sympathy.
making that even worse the tumblr post she got the out of context quote from included a link to my mom’s obituary. she had every reason to know that was a real obituary about my mom’s passing. it’s on the website for the local paper here. she’s stalked me well enough to know my name, address, the name of my father, and even more personal information despite the fact she lives in another country. she knows my niece’s name because of the kickstarter for my niece’s comic. all that information was there, she should have been able to see enough information to confirm that was my mom’s obituary. meaning even if it was a misunderstanding from translating it via online translator from English into her native language, French, she should have taken the statement as sarcasm if she really thought I had said that I lied about my mom’s death.
furthermore, I’ve had issues with depression for years and altho my depression issues had been minimal lately, her bringing the death of my mom back up like that made me relive being the one to find my mom had passed away while she was taking a nap and the aftermath of it triggered a major depressive episode I am still trying to deal with.
showing no shame, no decency, no morals, she refuses to clear the issue up, allowing her asskissers to believe she was telling the truth when she shared that incomplete quote out of context to really believe I am that type of terrible person. to see them compare me to the lowest of the low, such as saying that I am “as low a Trump.” she has a clear out for it, she can say the translation she saw was flawed, but she will not recant. she continues to use an out of context quote related to one of the most emotionally traumatic events in my life to make people think I am a horrible person.
