Phoenix was at first taken aback by the homunculus’ harsh words. Yes, it’s kind of hard to disarticulate the concept of war with death, but a) there’s no assurance that they’re indeed under war at the given moment; b) even if they are at war, they aren’t in war against each other, but against whatever is the threat against humanity; and c) it was clear that Garie had more than enough ability not to kill those poor people.
All of these details prove that Garie not only assumed the risk of killing - she intended to. Which means, she committed murder. “Yeah, they were. Although it’s not like you can speak so highly about it. Don’t think I tend to make that sort of mistake tw- Ghhhh!!”
He was suddenly shut by the girl’s sudden threat. This cold sensation… is she trying to freeze him? (Great, my big mouth and I…) There was no way that he’d stand physical combat against her. She’s clearly more suited for that than him. Anyone else would have just stood quiet and backed away.

Ah yes, just like the days of the heretical songs, the voice that spoke to her was that of naivety and hypocrisy. A voice that had such weight behind it, as if it were unilateral fact. It was her favorite type of speech. Because it would let her completely crush his way of thinking.
She was not a fool however. She had laid a bait, so for now, she would wait to see how the other would move. And even she admitted to herself, it was not an action she expected that occurred. The materialization of a book. A personal skill? Perhaps a Noble Phantasm? She had no idea, no basis to create a theory on. However his words did betray him in a way he did not expect, at least she supposed.
“Perhaps you will be interesting after all...” she said, twirling away, and taking a slight jump backwards. If she had wanted all it would have taken was to drive a dagger of ice through his throat, but that would have been a much more boring end than she desired.
“You say you will accuse me through legality, yes? Then let me run through the facts of the case thus far,” her gaze was fierce, her smile large. This would be unexpected, she thought to herself.
“These creatures that may as well be beasts thought it wise to attack me. So I returned their intentions. Thus, my initial actions would be seen as self defense. During that time, I felt a gaze watch me for a prolonged period of time. That was you, correct? In the place I come from, that could be viewed as the acts of a stalker. The next event was you’re own self coming under attack, and requesting aid. Thus my actions would be viewed as the defense of others. Ah, but let us say temporarily that what I preformed was indeed murder yes. Would your request then, not make you an accomplice to the crime?”
Had it been Leiur, the man would have simply been shot. Had it been Micha, the idiot would have likely been too stunned to react. Perhaps Phara would have comprehended, but she would have reacted much different. But Garie, Garie was the one where much of Carol’s intelligence was placed. Where most of her memories resided.
The memories most relevant, were those of the trials of the witches her creator’s father had endured.
