Why Are Children with ADHD or Autism Being Arrested at School? 🤨

Did you know that children, ages 6-10, are leaving school in handcuffs? CBS News released an article on why this occurs.  

Here are some key points from the article:

 Remote Learning Impact

During the 2020-2021 school year, over 100 elementary school children were arrested, a decline from previous years. Remote learning due to the pandemic likely contributed to this decrease in arrests.

Civil Rights Concerns

Department of Education data revealed that children with disabilities, including ADHD and autism, are four times more likely to be arrested at school. The Civil Rights Office is investigating potential civil rights components related to these arrests.

Historical Trends Arrests of children in grades 1-5 have consistently declined, as recent data shows. However, it remains uncertain whether the numbers would have been higher in a non-pandemic year.

Disproportionate Impact

Students of color face arrest rates over twice as high as white students. The disparities in arrests highlight broader issues, including access to advanced curriculum, internet availability, and school discipline.

Legislative Response

Recent incidents and public outrage have prompted legislative action. A Senate bill introduced in May 2023 aims to ban schools from using restraints like handcuffs for disciplinary reasons. However, a 2022 bill, the Counseling Not Criminalization in Schools Act, designed to reduce school arrests, did not pass.
